Woman Challenges Her Own Jury Instruction


A St Louis woman convicted of robbery and armed criminal action appealed her convictions to the Missouri Supreme Court, challenging an instruction the trial court submitted to the jury at her request.

In a unanimous decision the high court Tuesday affirmed the convictions.

 

The ruling noted that “…it defies logic and Missouri law to allow a defendant to proffer an instruction and then challenge the trial court’s submission of that instruction to the jury.”

In a unanimous decision written by Judge Mary R. Russell, the court affirms the trial court’s judgment. By jointly proffering the challenged instruction, the court held the woman waives appellate review of it.
