(Update) Preliminary Hearing Scheduled For Sex Offender Charged With Sex Assaults On Young Children

A  registered sex offender now charged with sexually molesting two young children was arraigned Friday in Buchanan County Circuit Court. The victims are each under the age of nine.

According to court documents, 25-year-old Michael Bozarth is accused of various sex acts with the children between 2010 and January 11, 2013. He is charged with three counts of first-degree statutory sodomy.  Each count carries a possible life prison term upon conviction.

Bozarth was arraigned Friday via video conferencing.  Bozarth told Associate Circuit Judge Ronald E. Taylor that he would apply for a public defender to represent him.  Judge Taylor scheduled a preliminary hearing February 26 at 10 a.m.

Bozarth was in jail when the warrant was served, and has an extensive history of crimes related to sex, drugs and violence. When the current warrant was issued, he was serving a 90 day sentence for his guilty plea January 16 to one count of third degree assault.

In July of 2005 Bozarth was convicted of sexual misconduct, sentenced to 15 days in jail, and ordered to register as a sex offender. Since then he has pleaded guilty and was sentenced to 252 days for loitering near a school building. In June of 2007, he pleaded guilty for failing to register as a sex offender. He was sentenced to five days in jail, according to court records.

He is still serving jail time for the assault case. Bond was set at $100 thousand on the current charges.
