Revised Smoking Ban Goes To Spring Ballot

smoke ringsVoters will decide this spring whether to ban smoking in many indoor places. The St Joseph City Council Tuesday accepted a revised clean-air ordinance and placed it on the ballot April 8.

The new language changes the so-called “trigger” under which the St Jo Frontier Casino could no longer allow smoking on their gaming floor.

Under the revised ordinance, the casino would have to bar smoking if it were banned at competing gaming houses in the Kansas City area.

A lawyer for Affinity Gaming told the council that the new language removes a legal difficulty described by critics as a delegation of legislative authority.

The council voted 6-3 to accept the modified language, which was agreed to by representatives of the petition committee and Affinity Gaming. Council then allowed the committee to withdraw its petition. The two votes allow the amended ordinance to go before voters April 8.
