TOPEKA, Kan. (AP) — A Kansas Supreme Court justice won’t be taking her seat on the federal appeals court until late July because of pending Kansas cases.

Justice Nancy Moritz’s appointment to the 10th Circuit Court of Appeals was confirmed in May.

The Topeka Capital-Journal reports the 84 days between Moritz’s confirmation and move to the appeals courts is unprecedented. The average amount of time between confirmation commission has been about three days for the 42 other justices appointed since 1929.

A spokeswoman for the Kansas Judiciary says Moritz wants to finish her business in Kansas, which includes three death penalty cases.

Judicial selection expert Russell Wheeler of the Brookings Institute says the 10th Circuit’s relatively light caseload makes it easier for Moritz to wait before assuming her new post.
