INDEPENDENCE, Mo. (AP) — Authorities say two men have been charged in a break-in that left a burglar dead and a homeowner injured in Independence.
The Jackson County prosecutor’s office said Sunday that 41-year-old Phillip A. Kisner and 18-year-old Dustin Donlan face charges of burglary and second-degree murder in the Friday incident.
The prosecutor’s office says Kisner and Donlan were participating in a robbery when the homeowner returned to the house. Police say shots were fired, striking the homeowner and a third person, who was killed.
It’s unclear who fired the shots. Kisner and Donlan face the murder charge because the person was killed during the commission of a felony.
A police spokesman told the Independence Examiner the homeowner was in critical condition Sunday.
It wasn’t immediately clear whether Kisner and Donlan had attorneys. An arraignment is set for Monday.
