A jury trial was set Tuesday in Buchanan County after a change of venue was granted for a man accused of kicking and biting and punching officers in Andrew County last year.
Carl Bernard Kelley III, 34 of Ill. is charged with three felonies for assault on a law enforcement officer, felonies for second-degree burglary, theft/stealing, possession of burglary tools, and misdemeanors for resisting arrest, operating a motor vehicle in a careless and imprudent manner and second-degree property damage.
The charges stem from an incident we reported on that took place in Nov. According to court documents, the Andrew County Sheriff’s Department responded to 59 highway to find Kelley asleep in the passenger seat of a white van parked in the driving lane. After attempting to get Kelley out of the van, officers said he refused stating that he was with the C.I.A. an altercation allegedly took place.
A change of venue has been granted and a jury trial was set for Jan. 24, 2017 in Buchanan County in front of Judge Patrick Robb.
