Two men appeared by video conference in Buchanan County court Friday on charges stemming from a police pursuit Sunday in which shots were allegedly fired at officers.

Dakota Sears, 25 is charged with a class-A felony of first-degree assault and Preston Funk, 26 is charged with a class-E felony of resisting arrest.

According to court documents, on Sunday, Funk was with a person wanted by police in the 900 block of Ridenbaugh.

“When officers arrived, Funk left the area and picked up the friend that was actively evading police. Funk led police officers on a pursuit through downtown,” said Det. Dustin Robinson with the St. Joseph Police Department. “Sears discharged a gun multiple times from a moving vehicle at law enforcement officers while they were in their vehicles.”

Robinson said Funk was involved in a crash and jumped out of a moving vehicle and took off running from police allowing the vehicle to roll forward without anyone driving it. Robinson said Sears also attempted to run from the vehicle.

“A firearm was located in the vehicle that matched the shell casings found on the scene,” Robinson said.

As we previously reported, one suspect received minor injuries during the incident.  Also, an officer received minor injuries when his patrol vehicle crashed and the airbag deployed.

Sears and Funk are due in court Sept. 7 for a preliminary hearing in the case. Both remain behind bars in the Buchanan County Jail without bail.
