SPRINGFIELD, Mo. (AP) – Authorities say a Missouri man has been charged with drunken driving in a deadly crash.
The Springfield News-Leader reports that 51-year-old Toby Emery, of Springfield, is scheduled to be arraigned Feb 13 on the DWI charge. He has been released on his own recognizance. His attorney didn’t immediately return a phone message from The Associated Press seeking comment.
Police say he was driving a pickup truck that pulled out in front 31-year-old Christopher Oswald’s motorcycle in May. Oswald was rushed to a hospital where he died. Police say Emery wasn’t injured. He faces up to four years in prison if convicted.
