Former Topeka Doctor Sentenced For Health Care Fraud

A former Topeka physician has been sentenced for defrauding federal health care benefit programs.

Diana L. Carver, 47, pleaded guilty to one count of health care fraud and one count of unlawfully prescribing controlled substances.

Carver was placed on probation for two years and will be banned from receiving federal health care benefit program funds

In her plea, Carver admitted that after the Kansas Board of Healing Arts suspended her license on July 8, 2010, she continued seeing patients. She continued to practice medicine through November 2010, submitting false claims to insurance programs including Medicare, Blue Cross/Blue Shield of Kansas and FMH for services she no longer was licensed to provide. She used the name of her father, who was physician and who did not provide the services.

Carver also issued prescriptions and authorized refills of controlled substances after she no longer was licensed as a doctor. She used her father’s name and DEA registration number.

Carver also was convicted in state district court on charges of practicing medicine without a license.
