New Trial Pending; Not Enough Jurors!

A new trial will be scheduled next month for a southeast Missouri man accused of killing his girlfriend after a judge declared a mistrial for an unusual reason: Too few jurors.

Maurice Davis is charged with first-degree murder and kidnapping in the shooting death of 23-year-old Latosha Greer. She was found with a gunshot wound to the head outside a Charleston home in December 2010.

Davis told police the shooting was accidental.

Jury selection began last week. But once prospective jurors were excluded for various reasons, Mississippi County prosecutor Darren Cann says, there weren’t enough left for a trial.

The case is being heard in Cape Girardeau County on a change of venue.
