
Livingston County officials have a beef with the Daviess/Dekalb County Regional Jail.
It appears a staff member at the facility released a man just days before a Livingston County judge was set to sentence him on felony charges.
Sheriff Steve Cox says Donald Jordan Bigby, 19, was arrested on a Livingston County arrest warrant for alleged felony Forgery.
A judge set bond at $5,000 bond and on September 9, 2013 Bigby was extradited to the Daviess/Dekalb County Regional Jail.
Bigby appeared in a Livingston County courtroom on October 21, and according to online court records, pleaded guilty to two counts. Judge Thomas N. Chapman ordered a pre-sentence investigation and deferred sentencing until a Sentencing Assessment Report was completed.
But Cox says Bigby was also serving time at the DDCRJ on other unrelated charges, and when he completed that sentence, he was released. Cox says the staff member did not see or notice the Livingston County hold.
Mr. Bigby was released on October 26.
Mr. Bigby is now a fugitive and his location is unknown.
“We did not learn of Mr. Bigby’s release on October 26 until November 01, 2013” Sheriff Cox says in a news release.
“We still have a felony commitment for Mr. Bigby and it would be in his best interest with the Court to immediately surrender himself.”
Cox has spoken with administration officials at DDCRJ about his concerns over the matter, and has notified the Circuit Court and Prosecuting Attorney.
