Missouri public defender director asks Nixon for $10 million

court, judgeJEFFERSON CITY, Mo. (AP) — The director of Missouri’s public defender system is asking Democratic Gov. Jay Nixon for an additional $10 million.

Director Michael Barrett said Monday that the money is needed to help the agency adequately represent the state’s poorest individuals charged with crimes.

Nixon’s office did not have an immediate comment Monday about the request for more money.

Barrett cited a federal report released in July on the St. Louis County Family Court, which said young people accused of crimes often lack adequate legal representation.

Barrett says the agency’s most pressing need is to hire more public defenders.

Nixon cannot give the department $10 million without first asking permission from lawmakers during the legislative session beginning in January.

FERGUSON, Mo. (AP) — Prosecutors have filed 10 counts against Tyrone Harris, the 18-year-old black suspect who was critically wounded after being shot by police Sunday night in Ferguson.

The office of St. Louis County Prosecutor Bob McCulloch on Monday announced charges that include five counts of armed criminal action, four counts of first-degree assault on a law enforcement officer and one firearms charge. All 10 charges are felonies.

Harris remains hospitalized following surgery. Police have described his condition as critical.

County Police Chief Jon Belmar says the suspect was among about six people who fired shots during a protest. Belmar says the suspect spotted a van carrying four plainclothes officers and fired into the windshield. All four officers returned fire.

Harris’ father, Tyrone Harris Sr., says two girls who were with his son told him he was unarmed and “running for his life” when he was shot.

Judge voids Kansas same-sex marriage ban as unconstitutional

LGBT  GayWICHITA, Kan. (AP) — A federal judge has voided the Kansas ban on same-sex marriages as unconstitutional in the wake of a U.S. Supreme Court decision on the issue.

U.S. District Judge Daniel Crabtree summarily ruled Monday that the provision in the Kansas constitution that prohibits issuing marriage licenses same-sex couples or recognizing such marriages violates the Fourteenth Amendment to the U.S. Constitution. That ruling also applies to any Kansas statute, law, policy or practice that bars or fails to recognize such unions.

But Crabtree stopped short of issuing a permanent injunction so as to give Kansas the opportunity to voluntarily comply, as its attorneys have assured the court they will do.

The court says some facts in the court record suggest Kansas officials have not uniformly complied with the U.S. Supreme Court ruling.

13 states want judge to block new federal water rule

BISMARCK, N.D. (AP) — Missouri and a dozen other states are asking a federal judge in North Dakota to block a new rule that gives federal authorities jurisdiction over some state waters.

North Dakota Attorney General Wayne Stenehjem says he will request a preliminary injunction Monday.

The states filed a lawsuit in June challenging the rule by the U.S. Environmental Protection Agency and the Army Corps of Engineers. The states say the new rule illegally expands the jurisdiction of those agencies under the federal Clean Water Act.

The law goes into effect Aug. 28. The injunction seeks to suspend the new rules until a court can decide the case.

The other states joining the lawsuit with North Dakota are Alaska, Arizona, Arkansas, Colorado, Idaho, Missouri, Montana, Nebraska, New Mexico, Nevada, South Dakota and Wyoming.

One dead, one hurt in interstate highway shooting

St Louis Metro PoliceHAZELWOOD, Mo. (AP) — One man is dead and another is hospitalized in critical condition after a shooting on a suburban St. Louis interstate highway.

The shooting happened about 1:30 a.m. Sunday on Interstate 170 in north St. Louis County. Officers discovered a black Infinity SUV on the shoulder of the road with several bullet holes.

The driver, 32-year-old Brian Valley, was pronounced dead at the scene. A 31-year-old passenger is hospitalized with gunshot wounds to the arm and back.

Police say the men had been at a high school reunion party when an altercation occurred. No arrests have been made.

The Greater St. Louis Area Major Case Squad is investigating.

heroin balloonsBOWLING GREEN, Mo. (AP) — A St. Louis woman is accused of trying to smuggle heroin to a northeast Missouri jail inmate through a kiss. Bettye Wilson is charged with delivery of a controlled substance at a correctional facility and distribution of a controlled substance.

A message left with her attorney was not immediately returned.

Wilson, 66, was arrested July 19th. A probable cause statement says she planned to pass heroin balloons from her mouth to an inmate at the state prison in Bowling Green by kissing him. Instead, she swallowed five balloons of the drug.

Authorities say the balloons were recovered the next day. Wilson faces arraignment on Wednesday.

Police: cattle rustler enlisted help of children

cow cattleBLOOMFIELD, Neb. (AP) — A Nebraska man accused of stealing cattle faces multiple felony charges in Knox County.

Timothy Ketelsen, 44, of Bloomfield is accused of stealing cattle on at least five different occasions since November. Authorities say he sometimes enlisted his sons, ages 16 and 14, to help him load steers onto trailers at night.

According to authorities, Ketelson sold the cattle at various markets.

Ketelson faces charges including two misdemeanor counts of contributing to the delinquency of a child, felony illegal sale of livestock and six counts of felony theft.

Driver accused of stalking student he met on elementary school bus

school busPAPILLION, Neb. (AP) — Sarpy County prosecutors are accusing a former Gretna school bus driver of stalking a woman he met when she rode the bus as a girl. Kevin Klingensmith, 32, is charged with felony stalking.

Deputy Sarpy County Attorney Phil Kleine says officers were called to the woman’s residence on April 20th.

The family spotted someone running across the property. Kleine says investigators used camera footage to identify the man as Klingensmith. Klingensmith’s attorney says his client denies he was on the property.

Court records show that judges have approved nine protection orders against Klingensmith that were sought by the accuser’s family, starting when she was 11 years old.

Kleine says Klingensmith met her when he was a bus driver for Gretna Public Schools.

Drowning victim recovered at Truman Lake

MSHP boat2WARSAW, Mo. (AP) — Authorities say they have recovered the body of a Lincoln, Missouri man who went missing in Truman Lake. According to the Missouri Highway Patrol, the body of 32-year-old Jeromy D. Clutter was found about 8:50 a.m. Sunday. Officials say Clutter entered the water in the Long Shoal Marina area Saturday and never resurfaced.

Baby sickened after swallowing marijuana pill

marijuana pillsWICHITA, Kan. (AP) — Police are investigating after a 17-month-old child swallowed a marijuana pill in Wichita.

According to Wichita police, officers were called to Wesley Medical Center Saturday morning to check on the welfare of a child.

Authorities say the mother’s child told officers she had left her child in the care of a 20-year-old man and a 21-year-old woman while she was at work.

According to spokesman Sergeant Bob Gulliver, the mother said that when she picked up her child, she noticed the child was lethargic and unresponsive. After the mother took the toddler to the hospital, it was determined the child had ingested a marijuana pill.

It was not immediately clear what the child’s condition is.
