Kansas man charged with murder after dispute over dog

courtWICHITA, Kan. (AP) — A 32-year-old Wichita man is charged with second-degree murder after a dispute over who owned a pit bull.

Investigators allege Justin Rourke shot and killed 41-year-old Roman Padilla last week. Police say he went to Padilla’s home to retrieve a pit bull he believed belonged to him and shot Padilla. The dog charged toward people on the victim’s porch and was also shot to death.

The Wichita Eagle reports Rourke is also charged with animal cruelty and four counts of aggravated assault.

Rourke’s attorney, John Rapp, said Tuesday he’s eager to get to court to tell his client’s side of the story.

Rourke is being held in Sedgwick County jail on $500,000 bond. His preliminary hearing is scheduled for June 30.

Corps of Engineers declares emergency due to high river levels

612px-US-ArmyCorpsOfEngineers-LogoUNDATED (AP) — The U.S. Army Corps of Engineers has declared an emergency throughout its Kansas City District because of high river levels and a rainy forecast in northwest Missouri.

The Level III emergency allows sponsors of levees to obtain technical assistance for damage to qualifying levees caused by the high water.

Judd Kneuvean, emergency management director for the Kansas City District, says the corps has delivered 43,000 sandbags for use in the Blue River Basin. The corps also sent 1,000 sandbags to Manhattan, Kansas.

Kneuvean said that rivers throughout the district are “prime” for flooding after weeks of intermittent rains. He says part of the problem is water backing up into streams and rivers because of high waters in the Missouri River.

AT&T fined $100 million for misleading “unlimited” plans

smartphone-564152_1280WASHINGTON (AP) — AT&T Mobility LLC has been hit with a $100 million fine for offering consumers “unlimited” data, but then slowing their Internet speeds after they hit a certain amount.

The Federal Communications Commission, which regulates the telecommunications industry, says the company misled consumers with the plans. Officials say the company would slow speeds dramatically at times, to levels lower than advertised.

AT&T said in a statement that it will “vigorously dispute” the allegations. The company says it has been upfront with consumers and that the FCC had “known for years” that major carriers slow data as a reasonable way to manage their networks.

SPRINGFIELD, Mo. (AP) — Missouri school districts will be able to obtain the results of background checks more quickly thanks to a new website.

The Missouri State Highway Patrol’s enhanced Missouri Automated Criminal History Site has been launched. Districts are being trained this summer on how to access the secured website and use it.

The Springfield News-Leader reports that getting the results of background checks used to take weeks in the past for districts. The new system allows districts to get them online within a matter of minutes.

Another layer of the system, expected to be fully operational by early 2016, is designed to quickly alert districts if a current employee has been arrested or charged with a crime.

Kansas City airport to conduct simulated emergency exercises

KCI aerialKANSAS CITY, Mo. (AP) — Kansas City International Airport officials say the public shouldn’t be alarmed later this week if they see smoke, fire and emergency vehicles driving through the area.

The city’s Aviation Department and several agencies will be conducting a full-scale emergency exercise from 10 a.m. to noon on Thursday to evaluate the city’s response to a simulated aircraft emergency.

Airport spokesman Joe McBride says the activities are part of a continuous, cooperative effort to keep passengers, the public and airport staff safe.

The Federal Aviation Administration requires KCI to conduct a full-scale emergency exercise once every three years and smaller drills during off-years.

Thursday’s exercises will include explosions, smoke generators, debris on the airfield and volunteers acting as injured passengers.

Jury Update: Neither Royals, man hurt by flying hot dog at fault

KANSAS CITY, Mo. (AP) — A jury says neither the Kansas City Royals nor a man who was hurt when he was struck in the eye by a foil-wrapped hot dog were at fault in the accident.

Jackson County jurors said nobody Wednesday was to blame for the incident at a September 2009 Royalsgame.

Overland Park, Kansas, resident John Coomer sued the team, saying Royals mascot Sluggerrr recklessly threw a hot dog behind his back and struck Coomer in the eye.

A jury in 2011 found Coomer 100 percent at fault because he should have been paying better attention. A Missouri appeals court disagreed in 2013, saying mascots aren’t necessary to play the game of baseball.

The Missouri Supreme Court concurred and sent the case back to Jackson County for another trial.

Missouri man convicted of killing wife freed while awaiting new trial

courtTROY, Mo. (AP) — An eastern Missouri man sentenced to life in prison for the killing of his wife is now out of jail awaiting a new trial.

The St. Louis Post-Dispatch reports that 45-year-old Russell Faria of Lincoln County was released Tuesday after a relative posted $500,000 bond.

A judge granted a new trial on June 5. Faria’s attorneys claim that newly discovered evidence would have changed the outcome of the trial that led to his first-degree murder conviction in the 2011 stabbing death of Betsy Faria.

The order primarily focused on the actions and statements of Pamela Hupp, Betsy Faria’s friend. Betsy Faria had changed the beneficiary on $150,000 of her life insurance to Hupp days before the killing.

Faria’s new trial starts Nov. 2.

Missouri man dies when car swept away by floodwaters

wpid-mshp-logo111.jpgSULLIVAN, Mo. (AP) — A 60-year-old eastern Missouri man has died after his car was swept away by floodwaters.

The Missouri State Highway Patrol identified the victim as John Lyons of Sullivan.

The accident happened Tuesday near Meramec State Park. Lyons was driving a 1992 Lexus when he tried to cross a flooded road. The waters pushed his car off the roadway and it overturned, killing Lyons.

Heavy rain over the past several days has caused rivers to rise drastically in Missouri. Several are now well above flood stage, and more rain is expected through most of the week.

Abuse charges dropped against a Missouri priest

175px-Roman_Catholic_Archdiocese_of_Saint_Louis.svgST. LOUIS (AP) — The St. Louis circuit attorney’s office has dismissed charges against a priest accused of sexually abusing a boy in a Catholic school bathroom, but left the door open to refile those charges in the future.

Circuit Attorney Jennifer Joyce’s office released a statement Wednesday announcing dismissal of two felony counts against the Rev. Xiuhui “Joseph” Jiang. He had been accused of twice abusing a male victim under the age of 14 between July 2011 and August 2012.

Jiang’s attorney, Paul D’Agrosa, said the allegation was false and charges should never have been filed in the first place. He says Jiang is hopeful that the Archdiocese of St. Louis will reinstate all of his privileges.

A spokesman says the archdiocese will have a statement later.

Levee breaches in northwest Missouri raise concerns

OREGON, Mo. (AP) — Two recent levee breaches in northwest Missouri have raised concerns about flooding in the region.

A breach in the Squaw Creek levee in central Holt County has flooded acres of farmland and another breach late last week along Squaw Creek closed sections of U.S. Highway 59 and Interstate 29.

Holt County Sheriff Scott Wedlock says no homes are threatened, but additional rain could create more problems.

He says the Missouri State Highway Patrol has helped evaluate the breaches.

In 2010 and 2011, floods hit Holt County homes, infrastructure and campgrounds.
