Harness sentenced in Metro-PCS robbery

A St. Joseph woman will serve 12 years behind bars after taking part in robbing a cell-phone store earlier this year on S. Belt highway.

Shania Harness pleaded guilty to the class a felony count of first-degree robbery in March. At that time, Harness who was pregnant, admitted that she and co-defendant Isaiah Williams, who is the father of her child, robbed the Metro PCS at gunpoint.

“I regret it every single day…It’s not me,” Harness said in court Wednesday in front of Judge Patrick Robb.

“Your statements don’t ring credible,” Robb said. “You only regret this because you got caught.”

Williams was also sentenced last week to serve 16 years for his role in the crime.

(Update) U.S. 36 crash kills truck driver

police lights feature(Update) The Missouri State Highway Patrol says a truck driver from Kearney was killed Tuesday in a single vehicle crash west of Stewartsville that shut down U.S. Highway 36 for five hours.

A crash report says Paul Binkley, 30, was driving a dump truck in the westbound lanes at 2:50 p.m. when he lost control of the vehicle. The truck left the roadway and struck a utility pole before overturning. Binkley was ejected in the crash and wound up underneath the truck. He was transported to Mosaic Life Care where he was pronounced dead.

The truck came to rest across both westbound lanes on its passenger side. The accident closed the road until about 8 p.m.

Indictment: Kansas man tried to dispose of hazardous materials by burning truck

usdoj-smallA southeastern Kansas man is charged with unlawfully trying to dispose of hazardous waste by setting fire to it, and the truck hauling it.

U.S. Attorney Tom Beal said that Jack E. Smith, 37, Scammon, Kan. was charged in a grand jury indictment announced Tuesday.

Smith is charged with one count of unlawfully transporting hazardous waste and one count of unlawfully disposing of hazardous waste in violation of the Resource Conservation Recovery Act. The indictment alleges that Smith towed a panel truck containing polymers and paints used in the making of gymnasium floors to property owned by his uncle in Crawford County, Kan. Neither he nor his uncle had a permit to transport, store or dispose of hazardous waste.

Smith is alleged to have attempted to dispose of the hazardous waste by setting fire to the truck.

If convicted, he faces up to five years in federal prison and a fine up to $250,000.

Missouri lawmakers approve record school funding

Logo_main_colorMissouri public K-12 schools appear set to get roughly $48 million more in basic aid next fiscal year. Senators voted 19-14 Tuesday in favor of bumping up funding to meet targets called for under state law.

House members also passed a proposed budget for the fiscal year beginning in July that would meet funding goals. That means the money is likely locked into the proposed budget.

A bipartisan coalition of 19 Democratic and Republican Senators came together to pass the Senate budget amendment to fully fund the current Missouri School Finance Formula. Observers say that Tuesday’s Senate vote and similar action previously taken in the Missouri House, public schools in the Show-Me State will see record funding in the upcoming fiscal year.

The vote Tuesday occurred on an amendment to House Bill 2, the appropriations bill for the Missouri Department of Elementary and Secondary Education.

Kansas woman indicted for allegedly providing weapon in triple-murder

A Kansas woman was indicted Tuesday on federal charges of providing a gun to a man who is charged with shooting and killing three people near Moundridge, Kan.

According to U.S. Attorney Tom Beall, it is alleged that on Oct. 29, 2016, Myrta M. Rangel, 31, Wichita, gave a .40 caliber handgun to Jereme Nelson.

Nelson is charged in Harvey County District Court with killing three people: Travis Street, Angela May Graevs and Richard Prouty.

The indictment charges Rangel with:
* One count of aiding and abetting possession of a firearm in furtherance of drug trafficking (count one).
* One count of possessing a firearm in furtherance of drug trafficking (count two).
* One count of conspiracy to carry a firearm in furtherance of drug trafficking (count three).
* One count of transferring a firearm to be used in drug trafficking (count four).
* One count of unlawful possession of a firearm following a felony conviction (count five).
* One count of giving a firearm to a convicted felon (count six).

If convicted, she faces the following penalties:
* Count one: Not less than 10 years and a fine up to $250,000.
* Count two: Not less than five years and a fine up to $250,000.
* Count three: Up to 20 years and a fine up to $250,000.
* Counts four, five and six: Up to 10 years and a fine up to $250,000.

The Kansas Bureau of Investigation and the Bureau of Alcohol, Tobacco, Firearms and Explosives investigated.

Judge to argumentative lawyers: “I’m embarrassed for both of you”

Cross talk between two lawyers in a Buchanan County courtroom reached a tipping point for the judge Tuesday, and what was expected to be a half-day trial is now scheduled for a second day.

“I’m embarrassed for both of you, quite frankly,” said Circuit Judge Daniel Kellogg. “From now on you will address your comments to me.”

Assistant Prosecuting Attorney Kate Schaefer and defense lawyer Joseph Morrey squared off in the trial of a jailhouse nurse accused of inappropriately touching two detainees. Carlos Marte, is a nurse working for Advanced Correctional Healthcare under contract with the Buchanan County Jail. He is charged with two counts of sexual contact with a prisoner, after the women accused him of inappropriately touching them during examinations last year.

During interviews with an investigator, Marte has denied doing anything inappropriate.

Testimony in the case has been riddled with objections from both sides, escalating the frustration of Judge Kellogg to the point of outright anger. The lawyers disagreed on what to call it when the defendant gave different answers to the same questions during two different interviews with the investigator. They disagreed on whether the interviews rose to the level of a criminal investigation, and whether Marte should have been read his Miranda rights. They disagreed on whether the room where the interview took place was in “the bowels of the Buchanan County Jail” or “the place where the defendant works.”  There was even a disagreement on precisely where the crotch ends and the genitals begin.

And with each disagreement, their comments and objections were directed increasingly at each other.

“If this was a jury trial, I’m sure it would make them angry,” Kellogg said. “It makes me angry.”

Following the dispute Tuesday, Judge Kellogg said he would watch more than two hours of video recordings of various investigative interviews. That followed one video already introduced as evidence, under objection. It was not clear whether the additional videos would be allowed into evidence, but it was clear there would be another objection.

The trial will resume on Wednesday with at least one more prosecution witness. Then Marte and his wife are expected to take the stand for the defense.

Four kids detained after crash at Hyde Park

silver sjpd patrol carThe St. Joseph Police Department has taken four kids to juvenile detention after a crash involving a stolen vehicle Tuesday in front of Hyde Park.

Officer Joe Herrera said Tuesday morning, police attempted to pull over a black Mitsubishi Outlander for a traffic violation prior to knowing it had been reported stolen. The driver of the vehicle eluded officers and got away. Later in the day, Hererra said another officer was driving in the area of 28th and Olive and saw the vehicle operated at a high rate of speed, 60 miles per hour in a 25 mile an hour zone. Herrerra said the vehicle again, got away before the officer could make a traffic stop.

“Later on in the day we got several phone calls from witnesses about this black vehicle driving…careless and imprudent all over the roadway,” Herrerra said. “We started driving around the area and then we heard over the radio that a witness said the vehicle crashed in the area of Hyde Park on the west side.”

Herrera said when officers arrived on scene they saw the vehicle had wrecked in some bushes and several kids ran from the car.

“All juveniles were recovered after a search of the area and taken into custody and transported to juvenile detention,” Herrera said.

The suspects ranged in age from 12 to 16 years. Herrera said three boys and one girl were taken into custody. No injuries were reported.

Herrera said the vehicle was stolen earlier this week.

Homicide investigation underway in Atchison, Kan.

A homicide investigation is underway in Atchison, Kan. into the death of a 49-year-old man.

Atchison Police Chief Mike Wilson said shortly before 7 p.m. Monday police responded to a home in the 1100 block of Parallel. Michael Moeck of Atchison, Kan. was found deceased.

“An investigation, now considered a homicide, has been on-going since Monday evening,” Wilson said.

Wilson said he requested the assistance of the Kansas Bureau of Investigation and the agency has been working with the police department since Monday evening.

Primavera Italian Restaurant to fill former Carlos O’Kelly’s building

fork-1119595_1920Primavera Italian Restaurant will be setting up shop in the building that previously housed Carlos O’Kelly’s in St. Joseph.

According to a news release from East Hills Shopping Center, the plan is to open up for business in late summer or early fall.

Primavera Italian Restaurant touts itself as a family owned and operated business that serves authentic Italian food featuring recipes from the owner’s grandmother. The restaurant will serve lunch and dinner. The menu will include pasta, New York-style pizza, seafood, beer, wine and desserts. Each table will receive complimentary fresh, homemade rolls. Their house specialties include fettuccini alfredo, chicken pomodoro and chicken broccoli tortellini. They also own Tuscany Italian Restaurant, which is located in Blue Springs, Mo.

“We are excited to welcome a friendly, family owned restaurant to the East Hills tenant line-up and hope to introduce St. Joseph and the surrounding communities to some authentic Italian flavor,” said Caroline Thalasinos, General Manager of East Hills Shopping Center.
