Hiawatha man gets 7 years for beating of two year old.

Frank Lee Rodriguez
Frank Lee Rodriguez

A Hiawatha, Kansas man was sentenced this week for the serious beating of a two-year-old child last August.

As we reported earlier, Frank Lee Rodriguez was found guilty after a bench trial in January. Rodriguez, 25, initially denied hitting the youngster, but then told Hiawatha police the child was not eating and he got upset, slamming the toddler onto the floor and punching her in the head.

The child spent more than three months in intensive care at Children’s Mercy Hospital before being released last December.

On Monday, Brown County District Judge John Weingart ordered Rodriguez to serve 52 months for aggravated battery, and an additional 34 months for felony abuse of a child, for a total sentence of more than seven years.

Boil advisory lifted

Missouri American WaterbMissouri American Water has lifted a boil advisory for a large area south of St. Joseph, in effect since a water main break March 5.

Officials said they had one area in the system that dropped below their minimum pressure requirement (20 psi), and as a result issued the advisory as a precaution.

Over the next day or two they had continuing issues with drops in pressure as they worked to refill storage tanks. The utility said there was no evidence of actual contamination.

On Tuesday afternoon, MAW issued this advisory: “THE PRECAUTIONARY BOIL WATER ADVISORY IN ST. JOSEPH HAS BEEN LIFTED. THERE ARE NO ADVISORIES IN EFFECT AT THIS TIME, AND IT IS NO LONGER NECESSARY TO BOIL THE WATER PRIOR TO CONSUMPTION.”

Wednesday March 8 is the last day to register to vote in the municipal election this spring. There are no issue or candidate elections in St. Joseph, but there are a few in rural parts of Buchanan County.

Buchanan County Clerk Mary Baack-Garvey says her office will be open for you to register to vote until five p.m. on Wednesday.

*Voters in Gower will select a mayor in the election, as well as two members of the board of the Gower Fire Protection District.
*Voters in the East Buchanan C-1 school district and the Buchanan County R-4 school district will select members for their school boards.
*The Village of Agency will select two members for its board of trustees.
*The Platte County R-1 District hopes to borrow $6.2 million to fund a new junior high school and some roof repairs, and they’re asking for the voters’ okay.
*There are no candidates on the ballot in Lewis & Clark Village, where they’re hoping to fill two seats on the Board of Trustees.

The municipal general election is April 4.

Man accused of assaulting stranger appears in court

Benjamin Lee

A man accused of attacking a woman he didn’t know at a local store will remain behind bars awaiting his next court appearance.

As we reported earlier, bystanders allegedly restrained Benjamin Lee at the Menards store in St. Joseph on Friday March 3. In court documents, St. Joseph Police Detective Chase Cotter says the victim and witness statements match up with store security video that allegedly depicts Benjamin Lee attacking the woman.

According to the affidavit of probable cause, “…the defendant assaulted the victim without provocation…by wrapping his arm around her neck and strangling her.”

“The defendant then brought the victim to the ground and put her head between his legs and pulled upward on her chin,” the affidavit states, and then “…grabbed the victim by the inside of her mouth and began dragging her.”

The victim says she is not from this area, and does not know Lee. She was hospitalized with bruises as well as mouth and neck injuries.  In the court affidavit, Detective Cotter said the victim was “extremely upset and distraught” by the incident.

Lee is being held in the Buchanan County Jail, charged with first-degree assault, a class-b felony. On Tuesday he appeared via video-conferencing before Associate Judge Keith Marquart.  St. Joseph attorney Tim Warren also appeared on Lee’s behalf.  Judge Marquart scheduled the case for a preliminary hearing March 17. The judge said he would also consider a motion to reduce Lee’s $25,000 cash bail at that time.

Now that the sun is up, crews are assessing the damage after Monday night storms hit the area.

American Red Cross Northwest Missouri Executive Director Angie Springs said they are in evaluation mode.

“The first and foremost thing that we’re going to be doing is circling around the impacted areas, handing out supplies as people start to clean up and clean out and evaluate the damage,” Springs said. “So that’s our goal today (Tuesday) is to take a look at what areas are impacted, what are the needs of those people that have been impacted by the storm and what supplies can we give them to help make this clean up process a little easier.”

Springs said, so far, they have been hearing of home damage especially in Clinton County where potentially 25 to 50 homes were impacted mainly in the southwest part of the county.

Springs said the Red Cross is making its first stop in Clinton County to assess damage and people can help by staying out of impacted areas so emergency personnel can begin cleaning up.

“This is the reason why the American Red Cross raises funds. Right now we’re in the middle of our Heroes Campaign and this is what your money goes to help support,” Springs said. “One of the best ways to help… is by making a financial contribution to the American Red Cross so we continue doing the good work that we do right here. You never know when it’ll be in your backyard.”
