Woman faces charges after allegedly firing a gun during argument with her kid in the room

court, judgeA St. Joseph woman is facing several charges after allegedly firing a gun in a duplex in Country Club Village with children inside.

31-year-old Tiffany Diaz was charged Thursday in Andrew County with a felony for unlawful use of a weapon, a misdemeanor for third degree domestic assault and a misdemeanor for second degree endangering the welfare of a child.

According to court documents deputies responded Thursday to the 3200 block of Squire Lane in Country Club Village in reference to a neighbor overhearing a woman and a man arguing about a gun.

“She heard a pop noise which sounded like a gun shot from the house where the argument was coming from,” Deputy Daniel Glidden said in court documents.

Glidden said he interviewed the man at the residence who said that he and his girlfriend got into a fight and she became physical so he tried to restrain her arms, at which point he said she pulled a gun and they fought over it.

“He told her that she was going to jail and she then pointed the gun at the ground and fired off a round,” Glidden said.

Glidden said Diaz’s 7-year-old son was allegedly just a few feet away during the incident.

He said after the Missouri State Highway Patrol located Diaz at her parent’s home in St. Joseph she came voluntarily for questioning.

“The residence where the shot was fired from is a duplex that is adjoined by another family with 2 adults and 2 small children who could have been killed or seriously injured by Diaz firing the gun,” Glidden said. “Diaz said later that she was not even for sure where she fired the shot.”

Diaz is being held on $20,000 bond.

Traffic issues due to police activity in St. Joseph

A police incident in St. Joseph is causing issues for motorists in the area.

As of 10 a.m. the Missouri State Highway Patrol had closed off I-29 to northbound and southbound traffic from mile marker 44 to mile marker 50. I-29 is being diverted at 229.

The Missouri Department of Transportation said Traffic is also being divert at 169 which is mile marker 50 due to the incident.

The St. Joseph Police Department is also telling motorists to avoid Frederick Blvd near I-29 for a police incident.

The St. Joseph Police Department is preparing to block traffic at Frederick and Woodbine.

Business in the area have evacuated or are on lockdown.

The Missouri State Highway Patrol and the St. Joseph Police Department is currently on scene at Motel 6 in St. Joseph near Frederick and I-29 for an active standoff. Our reporter said he saw what looked like a flash bang and possibly a shot fire around 9:30 a.m. Earlier this morning one of our employees, James Fisher reported hearing a gunshot and a lady scream the run across the parking lot.

10:10 a.m. – I-29 is being diverted at 229.  Businesses in the area on lockdown including our own station.  Tretbar reports shelter in place at Dennys and Red Lobster.

9:45 a.m. – The Missouri State Highway Patrol is blocking off I-29 northbound and southbound from mile markers 44 and 50 due to the police response to Motel 6.  The St. Joseph Police is also telling motorists to avoid I-29 near Frederick due to the police incident.

St. Joseph Post’s John P. Tretbar is on scene and said he has heard from bystanders that there was reportedly one shot fired in one of the rooms. He said employees reportedly heard a shot and scream just after 8:30 a.m.

Just after 9:30 a.m. Tretbar was on scene and reported hearing what sounded like two shots fired.

St. Joseph Post’s James Fisher said police are telling bystanders to go inside because a subject is shooting out the door of the motel.

Fisher said he actually saw the initial incident take place.

“Earlier this morning we were standing outside and we heard a gunshot and a lady scream and run across the parking lot,” Fisher said.

Around 9 a.m. Tretbar said he learned from a passerby that the original shooter may not be there anymore but that there may be another suspect.

“I have also learned from passersby that the original shooter may not be here anymore but there may be another suspect,” Tretbar said.  “We did watch as several kids were rescued from a truck that was in the parking lot.”

The hotel has been evacuated.

Tretbar said there are around 20 troopers and officers on scene as of 9:27 a.m.  Earlier he said that people trying to get in and out of the area cannot due to the police presence.

The St. Joseph School District has placed the Colgan Alternative Resource Center on lockdown as a precaution measure due to the alleged shooting incident.

Mother accused of delaying vaccinations for infant who contracted Whooping Cough

NIGHA St. Joseph mother is being charged after her 7-month-old daughter contracted Whooping cough.

30-year-old Melinda Nigh was charged Friday in Buchanan County with a misdemeanor for endangering the welfare of a child.

According to court documents on Oct. 8 Nigh refused to meet with a Missouri Department of Social Services worker Nicole Rudisill in reference to the placement of her daughter.

“Nigh delayed taking (her daughter) to the doctor for her immunizations and has now contracted Whooping cough for which Nigh is not seeking treatment,” said Officer Eric Powell with the St. Joseph Police Department.

He said Nigh did eventually seek medical attention for her daughter.

“The defendant delayed medical treatment of her child and did not finish the treatment once it was prescribed,” Powell said.

Powell said that an order for protective custody for the child’s well being was signed by a Judge on Oct. 8 but that Nigh refused to meet with the social services worker and refused to take a drug test.

“The defendant is believed to be abusing dangerous drugs while her daughter is present,” Powell said. “The defendant refused to cooperate with Rudisill and refused to cooperate with police when they attempted to make contact.”

Nigh is being held on $5,000 bond. A trial setting is scheduled for Oct. 27.

Charges filed after Monday morning standoff

Charges have been filed against a St. Joseph man after a six-hour long standoff with the Special Response Team earlier this week.

32-year-old Isaac Moore is charged with a misdemeanor for third-degree domestic assault. The charges stems from an incident that took place Sunday in the 1200 block of N. 26th St.

According to court documents Moore allegedly threatened to assault a woman while children were present.

“According to the victim Moore threatened to assault her if she called the police on him,” Officer Quentin Abbott with the St. Joseph Police Department said. “The victim stated Moore has assaulted her in the past. The victim’s and defendant’s minor children were present during this incident.”

As we previously reported, police responded to a residence in the 1200 block of N. 26th St just before 9 p.m. Sunday. After the subject refused to answer the door SRT was called out.

“Hiding inside his residence and failed to comply with numerous police orders, over an approximate 6 hour time period to come out of the house,” Abbott said. “These instructions were given to Moore via cell phone contact and loud speaker.”

Sergeant Brad Kerns said the standoff ended at 3 am Monday when officers entered the residence and apprehended the suspect. No shots were fired. There were no injuries. Sergeant Kerns said the suspect was the only one in the house.

Court documents state that based on evidence the court finds the defendant is a danger to the victim and denied bail. An arraignment is set for Oct. 20.

Two locals awarded for animal rescue efforts

The St. Joseph Animal Shelter held a special gathering Tuesday in recognition of two who received awards from the Missouri Animal Control Association. Ed Vanover, a volunteer with the animal shelter was awarded the “Paws for Applause.”

“They’re given out annually and they’re based on nominations from individuals or employees that work in the animal control field,” said Holly Bowie, Animal Control & Rescue Manager.

Bowie also received state recognition.  She received the “John Rhodes Award” for her efforts in increasing the department’s live release rate.

“It’s something that we’ve taken a lot of pride in and worked really hard on,” Bowie said. “Basically live release rate talks about how many animals come in versus how many go out so we’ve increased our adoptions, our redemptions, and our animals going to rescue significantly over the past few years.”

Bowie said the live release rate in dogs has gone from 40% to 80% in the past five years.

Charges have been filed against a child after a playground bullying incident was caught on cell-phone video.

A 12-year-old girl has been charged with a class D felony for assault on school property. The charge is in connection with an assault that allegedly took place at Hosea Elementary School and gained national attention after the video footage went viral on social media.

The video depicts a young girl repeatedly punching and kicking another girl, and dragging her by the hair some 30 feet or more across the asphalt pavement.

As we previously reported, the incident occurred on school grounds, but after school hours, on a Sunday.

We’re not posting the video because it involves minor-age children.

The first court setting will be held Friday, Oct. 16 in Division 3. The hearing will be closed because the defendant is a juvenile.

Gas prices rise, St. Joseph still highest in the state

Refinery maintenance is sending gas prices higher and St. Joseph is still one of the most expensive metros for fuel in the state.

According to AAA gas has held steady for 13 days but due to maintenance gas began ticking higher last week reaching today’s national average of $2.31 a gallon, an increase of two cents from a week ago.  In Missouri, gas jumped up 15 cents to an average of $2.25 a gallon.  But in St. Joseph gas made the biggest jump, up 19 cents to an average of $2.28 a gallon, three cents higher than the state average.

“It’s based on cost, oil cost, transportation cost, all types of factors,” said a St. Joseph gas station representative who didn’t want to be named. “It’s all got to do with competition.  Cost and competition.”

Once again, St. Joseph came in as the highest metro in Missouri to fuel up in. Kansas City held an average that was four cents cheaper at $2.24 a gallon.

Our source told us that’s because Kansas City has more competition so everyone is fighting for the gallons.  He said if St. Joseph had more competition to drive the price down it could go the other way.

The cheapest metro to fuel up in Monday morning was St. Louis holding an average of $2.16 a gallon.

AAA said the refinery maintenance season is reportedly nearing it’s peak.  The agency said before the end of the year, drivers could still see the national average fall below $2 per gallon for the first time since 2009, assuming crude oil prices do not increase and there are no unexpected disruptions to supply.

He was born July 20, 1955 in Cameron, MO, son of Shirley and Charles Bozarth. He was the owner and operator of Bozarth Texaco and the St. Joseph Telegraph newspaper. Mike was very involved in the community, serving as City Councilman for the City of St. Joseph, representing the South Side, as well as several service organizations such as the South St. Joseph Progressive Association. He was a member of the Christ Episcopal Church. Preceding him in death are his parents, and a brother, Charles A. Bozarth. Survivors include, two brothers, Greg (Shan) Bozarth, and Doug (Jamie) Bozarth of Saint Joseph, MO, sister, Sandra (Rob) Falter of Westphalia, MO, two nephews; James and Jared Bozarth, three nieces; Heather Sandlin, Brandi Smith, and Yoshi Su, several great nieces and nephews, and his lifelong friend, Becky Darr.

She was born September 22, 1945 in St. Joseph, Missouri.
Cheryl graduated from Lafayette High School, class of 1963.
She married Darwin Thomas Sheets January 25, 1964 and he preceded her in death in 2012.
She worked as an Executive Administrative Assistant at the YMCA, retiring after 48 years. Cheryl fully believed in YMCA’s mission statement “To put Christian principles into practice through programs that build healthy spirit, mind and body for all.”
Mrs. Sheets was a member of Faith United Church.
She was also preceded in death by her parents, William and Gertrude (Enke) Surface; son, Jason Sheets; and father and mother-in-law, Glen and Alpha Sheets.
Survivors include her sister, E. “Kay” Wilson, St. Joseph; brother, John Surface (Janice), St. Joseph; sister-in-law, Mary Pepple, St. Joseph; several nieces, nephews and cousins; and her YMCA family.

She graduated from Savannah High School and Missouri Western State University. She began her career as a secretary at Snorkel. She started her teaching career with the Savannah School District as a Remedial Reading teacher and retired in 2011 from the Union Star School District. She was an encouraging, positive influence for countless children through the years.
She attended the Cosby Zion United Methodist Church, where she served on various committees. Mary was a member of the Zion Cemetery Board serving as a secretary.
She enjoyed reading, playing the piano, researching family genealogy, and her flowers.
