U.S. Supreme Court ruling could affect Missouri’s abortion clinic law

(Missourinet) – The U.S. Supreme Court has struck down a court case involving Texas abortion clinic law, which is similar to Missouri’s. The court found that the Texas law’s requirements that abortion doctors to have admitting privileges at nearby hospitals and for clinics to meet the standards of an outpatient surgical center aren’t medically necessary.

Planned Parenthood President and CEO Laura McQuade says Monday’s ruling is the most important court decision facing reproductive health access in more than 20 years.

“These laws dramatically impact access to services. They dramatically impact both Planned Parenthood’s and independent providers’ ability to provide access to safe and legal abortion in the state of Missouri,” said McQuade.

She’s not sure if Planned Parenthood will make a legal argument to invalidate Missouri’s abortion clinic regulations. McQuade hopes to have that answer in the coming days.

The Columbia Planned Parenthood facility has not been able to perform abortions since December 1, 2015. The University of Missouri-Columbia ended those hospital privileges for the clinic’s physician who was able to provide abortions, Dr. Colleen McNicholas.

Pro-life supporters, including Missouri Right to Life spokesperson Susan Klein, decried the ruling.

“Basically today the court ruled today on a political agenda rather than ruling on the protection of women’s health. It’s not going to change what we do. We are going to continue to pass pro-life laws that save babies and protect women,” said Klein.

Klein also says the organization’s lawyers will try and determine if there are any legal avenues to allow Missouri’s abortion clinic laws to stand.

Missouri gun bill sponsors expect override of governor’s veto

(Missourinet) – The lawmakers who carried a sweeping gun rights expansion proposal say Governor Jay Nixon is missing an important detail in his rationale for vetoing it.

Nixon said in his veto message the bill would let people legally carry a concealed firearm even if they have been denied a concealed carry permit by a sheriff because a background check revealed criminal offenses or the sheriff believed the individual poses a danger.

“He fails to recognize that all those people that we’re allowing with the constitutional carry can currently carry openly in the state of Missouri,” said the bill’s sponsor, Senator Brian Munzlinger (R-Williamstown). “All this bill does is allow them to carry concealed where they would now have to carry open.”

“It’s not about how you carry but where you’d have the right to carry, and so getting the permit allows a person more privileges and locations of where they’re allowed to carry than where they currently cannot carry,” said Burlison.

“Personally I would rather see people carry concealed, especially our law-abiding citizens,” said Munzlinger. “What this bill does is give law-abiding citizens the right to protect themselves. In the crazy world we’re in we definitely need the right to protect ourselves.”

Both men believe the governor’s veto will be overridden when the legislature convenes for its annual veto session in September. Burlison expects some Democrats to vote with the governor but still believes there will be enough support to overturn the veto.

“There’s nothing changed and there’s no new information about the bill. Even the governor’s opposition is something that we discussed on the House floor and they discussed in the Senate,” said Burlison.

Burlison believes the governor’s veto is evidence that his eight years as governor, with an armed security detail, has made him forget what it’s like to be a citizen.

“If we were in the budget process I would be suggesting that we eliminate the budget for the governor’s security detail and instead give him a budget for him to purchase and carry a firearm himself so he knows and is reminded what it’s like to be a normal citizen,” said Burlison.

The bill would also expand the state’s “castle doctrine,” which allows homeowners to use deadly force against intruders by letting invited guests to also use such force. It also included a “stand your ground” provision to let people in a place they were legally allowed to use deadly force against a perceived threat, without retreating.

Nearly 500 state facilities will receive upgrades

(Missourinet) – Governor Jay Nixon (D) has signed into law two budget bills outlining more than $454-million in renovations to nearly 500 state facilities. About $262 million in upgrades will be made to Missouri higher education buildings and about $192 million in improvements will be made to other state facilities.

House budget vice chairman Scott Fitzpatrick (R-Shell Knob) says the improvements will make a difference, especially to higher education buildings.

“People on both sides of the aisle want to take care of state facilities and help our higher education institutions remain top notch to help attract good talent to Missouri,” said Fitzpatrick. “We’re making a dent in the backlog. That being said, the backlog is only going to continue to grow. The more state facilities there are, the more there is to maintain. It’s going to be one of those things that we just have to be diligent in prioritizing,” said Fitzpatrick.

The bills include:

$29 million for the Department of Conservation
$20 million for Missouri National Guard facilities
$12 million for the Department of Natural Resources
$7 million for Missouri’s port system
$7 million for the Department of Public Safety
$16 million for Missouri State University
$5 million for the University of Missouri’s Thompson Center for Autism

Dry conditions stress Missouri crops

(Missourinet) – Lack of rainfall is stressing Missouri’s crops according to University of Missouri Climatologist Pat Guinan. This week’s USDA Crop Progress Report says 40% of North Central Missouri’s fields and almost 30% of Northeast Missouri’s fields lack topsoil moisture.

“A lot of sunshine has really driven up evaporative demand. Those soils don’t have much moisture in them,” said Guinan. “What’s going to sustain the crops, is what falls from up above and that’s in the form of rainfall. Each day we go by with these summer like temperatures and no rainfall, conditions are only going to get worse.”

Guinan says farm fields in Mid-Missouri haven’t been this dry since 1992.

“Columbia tends to be the bulls-eye when we look at some of the deficits since January 1. We’ve racked up about a deficit in excess of eight inches,” said Guinan. “We’ve had just over ten inches of rain. That’s about 55% of normal for a five-and-a-half-month period.”

The USDA Drought Monitor categorized nearly 20% of Missouri as abnormally dry.

Missouri Congressman targets VA officials’ bonuses if top spots have lengthy vacancies

(Missourinet) – East-central Missouri congressman Blaine Luetkemeyer (R) is introducing legislation that would prohibit pay bonuses for senior VA officials if director positions at VA facilities go unfilled for more than 18 months. His proposal comes out of frustration that the St. Louis VA hospital has been without a permanent director for three years.

“The facility continues to get weak scores within the realm of all of the other VA facilities,” said Luetkemeyer. “It needs a lot of improvement and you need somebody at the helm to direct that improvement and right now it’s not happening.”

Luetkemeyer says 34 other VA facilities in the U.S. do not have a permanent director.

“This isn’t a problem that’s unique to us here in Missouri. It’s across the country. So we have some folks who aren’t doing their job. Yet they continue to give bonuses,” said Luetkemeyer. “We, in the U.S. House, normally eliminate all of those bonuses in our appropriations bills. The Senate winds up somehow putting those back in.”

If the Senate does not include the elimination of those bonuses, Luetkemeyer says his proposal would be “Plan B”.

VA Secretary Robert McDonald has said competing with the private sector makes it difficult to fill those top spots.

“The VA continues to get the budgets that they request basically. I understand that there are some problems with salary schedules, but that goes back to Mr. McDonald. If he can’t get find somebody for $50,000 a year, hire them for $70,000 a year,” said Luetkemeyer. “While that is a concern, it is more difficult for the VA to compete against the private sector, I can talk to the folks at the Columbia VA hospital and they don’t seem to have quite these kind of problems. To say that across the board that this whole problem is basically a pay problem, I would disagree with that.”

The number of VA officials who would be affected by these bonuses is unknown. Lucas West with Luetkemeyer’s office says the legislation is written broadly on purpose so that it can include whoever is involved in the hiring process.

Missouri bill to help domestic violence victims signed into law

(Missourinet) – A bill signed into law this week aims to help victims of domestic violence get out of abusive situations.

The legislation allows a victim of domestic violence who gets an order of protection to transfer a cell phone number to a new account separate from his or her abuser, even if it means breaking a contract with a provider.

Bill sponsor, Senator Ryan Silvey (R-Kansas City), said it will eliminate a lot of concerns for victims trying to get away from their abusers.

“The way that our cell phones and smart phones have become such a part of our lives and a part of our identities, being able to maintain that number and take it with you is what the advocacy community was really concerned with,” said Silvey.

(KOE-leen KOE-bull) Colleen Coble with the Coalition Against Domestic and Sexual Violence said it’s a simple change that will have a big impact on the lives of victims trying to get out of abusive situations.

“For most people if they just thought that tonight they had to leave their home and not be able to communicate with those who care about them and support them in a time of crisis it would be very difficult, especially if that very same type of communication could be used to track you by the person who’s been harming you,” said Coble.

Coble was pleased with the support the bill received from both parties in the legislature and the governor, as well as cell phone providers.

With the governor’s signature the change takes effect August 28.

MODOT to soon consider projects for resumption of cost share program

The Department of Transportation will soon consider applications for projects it would split the cost of with local governments.

The legislature and governor agreed to put $20-million in the state budget for the year that begins July 1 for MODOT to re-launch a cost-share program that was suspended two years ago. Under its new name, the Missouri Moves program will use that money to partner with local entities on transportation infrastructure projects.

Two-thirds of the 20-million will go to road and bridge work, with the rest to infrastructure supporting things like pedestrian and bicycle transportation.

The Highways and Transportation Commission at its meeting this week approved how that program will work, according to MODOT Director Patrick McKenna.

“[The commission] had directed the Department to look at a way to implement this in a way that would be objective and as fair as possible, and have some geographic spread to it as well,” McKenna told Missourinet.

MODOT outlined for the commission its criteria for how it will evaluate and rank projects submitted to it by local entities.

“Project readiness is a big part of it because we have to get these going, so to the extent that some have already gone through preliminary engineering or some of the environmental work that needs to be done to gauge whatever impacts the projects have,” said McKenna. “The ability of the community to bring forward matching funds is going to be a criterion as well. Safety is a high criteria that we’re very focused on – improving safety throughout the system, to the extent that we can engineer it, and those types of projects will probably score better.”

More details on those criteria will be released when MODOT begins taking applications for projects, which will be as early as June 15, and will run for 45 days.

McKenna says the department will try to move quickly with this program largely because it is subject to annual appropriations in the state budget.
