McCaskill: Missouri is 20% below national average for higher ed funding

Senator Claire McCaskill (D-Missouri) says the state’s higher education funding is too low, including from the Missouri General Assembly. She says state aid has been trending downward for a while.

“If I was a member of the Missouri Legislature, I would be worried about that,” said McCaskill. “I’d be worried about the fact that we are making it harder and harder for young people to get an education in this state because of a lack of funding coming from Jefferson City.”

McCaskill also says state lawmakers need to move on from last fall’s turmoil at the University of Missouri. She says it’s unfair to drive up tuition prices by cutting funding at Mizzou.

“I’m hopeful that the Missouri legislators will think about it and realize we need to look to the future of our state in terms of economic development, strength and that isn’t like trying to have some misguided political slam on a situation that maybe wasn’t handled perfectly,” said McCaskill.

Republicans contend the cuts they’ve proposed shouldn’t cause an increase in tuition.

State lawmakers are considering more than $8 million in budget cuts to Mizzou, largely in response to University leaders’ handling of racial protests on campus last fall and of former professor Melissa Click. She called for “some muscle” to be used to block a student journalist during those protests. After several weeks of public criticism, the Board of Curators voted earlier this month to fire Click.

Blunt: not unusual to block SCOTUS nomination during election year

(Missourinet) – Senate Republicans have vowed to block President Obama’s nomination for U.S. Supreme Court justice. They want to delay confirmation, in hopes that a Republican is elected president and will nominate a conservative justice.

Senator Roy Blunt (R-Missouri) says blocking the nomination during a Presidential election year is not unusual.

“There’s a long history in the country where if it’s a presidential election year going back to John Quincy Adams at least, that you didn’t fill a lifetime vacancy on the Supreme Court if it occurred when people are thinking about voting for the next President,” said Blunt. “Of the people who have been nominated to the court over the years, 36 of them never got on. Of the 36 that never got on, 25 of them never had a vote.”

Blunt said the nation’s highest court can manage with eight justices until the next President nominates someone to fill the vacancy.

“The first court had six members because nobody thought the court was going to be a legislative body. You didn’t need a tie-breaker. All you needed was somebody to look at the constitution, look at the law and determine if that should be the law,” said Blunt.

Some say split decisions would result in a lower court’s decision being final.

Democrats say Republicans are holding the vacancy hostage. Senator Claire McCaskill (D-Missouri) said the appointment should not be political and the vacancy needs to be filled.

U.S. Appeals Court Judge Merrick Garland has been nominated by Obama to replace the late Antonin Scalia.

Judge rules Missouri must reveal maker of execution drugs

(Missourinet) – The Missouri Department of Corrections must reveal the maker of its execution drug, a judge ruled Monday.

Cole County Circuit Judge Jon Beetem ruled the law that keeps confidential the identities of members of the state’s execution team does not apply to the maker of the drug used in Missouri’s lethal injections. He found the state violated the open records and meetings law by not releasing documents requested by new media and others, and ordered the state to pay $73,000 in the plaintiff’s attorneys fees.

The ruling has been stayed pending a likely appeal by the state, so the name of the drug maker won’t be released right away.

The Missouri Attorney General’s Office says it’s reviewing the ruling.

Missouri’s next scheduled execution is that of Earl Forrest, May 11. He was sentenced to death for the 2002 murders of a Dent County Sheriff’s Deputy, Sharon Joann Barnes, Harriet Smith, and Michael Wells.

Plan would tax and regulate fantasy sports in Missouri like gambling

A third bill on daily fantasy sports has been filed. This one would tax the industry and classify such activity in Missouri as gambling. Senator Scott Sifton (D-Affton) wants to regulate daily fantasy sports like casinos.

“Right now the river boats are regulated and they are taxed. The daily fantasy sports industry is not. All we are doing is extending the existing regime to this new form of entertainment,” said Sifton.

Sifton said he wants to level the playing field between both industries.

“If you’ve got certain kinds of gaming that are taxed at 21% and another form that is not taxed at all, that might create an incentive and distort the free market,” said Sifton.

Sifton’s bill calls for a 21% tax on daily fantasy sports companies and players would have to be at least 21 years old. Tax revenue raised would go to Missouri’s public schools.

“Tax revenues from one ought to be handled the same way as tax revenues from the other. I think it’s really important to keep it that way because if you acknowledge a willingness to potentially direct tax revenues elsewhere, you open Pandora’s box and it becomes a fight over who gets what slice of the pie. It makes it a lot harder to get this done in a way that I think is counter-productive,” said Sifton.

In his State of the State address, Governor Jay Nixon (D) called on state lawmakers to tax and regulate the industry like gambling.

Senator Kurt Schaefer (R-Columbia) and Representative Scott Fitzpatrick (R-Shell Knob) have introduced bills on daily fantasy sports, but neither would tax the industry or classify daily fantasy sports as gambling.

Missouri students and faculty safe in Brussels after terrorist attacks

Sixteen University of Missouri students in Brussels, Belgium are safe after a series of deadly terrorist attacks Tuesday against the city’s airport and subway systems. Some of the Mizzou students were near the site of the explosion at the transit station. Christian Basi with the MU News Bureau said the journalism students are in Brussels interning at different area media outlets.

“Our thoughts and our prayers go out to the families of the victims. This is a horrible tragedy. We are very fortunate that all 16 of our students are safe and accounted for,” said Basi.

At least one faculty member is with the group.

“We haven’t made any immediate decisions as far as continuing the program or having the students come home. The faculty over there along with officials here will assess the situation, they’ll be in touch with local authorities there and we’ll also be in touch with the state department here to make a decision that is in the best safety interests of the students, faculty and the program,” said Basi.

At least 34 people have been confirmed dead with the death toll rising. More than 130 people were injured in the attacks.

A suicide bomber was responsible for at least one of the explosions.

All flights to and from Brussels Airport have been cancelled for the day, and flights have been diverted. Subway, train, tram and bus travel has also been shut down.

The attacks come four days after one of the suspects in November’s fatal Paris terrorist attacks was apprehended in Brussels.

Missouri Senate Democrat Leader: First half of session ‘unproductive’

Senate Minority Leader Joe Keaveny (D-St. Louis) doesn’t think the first half of the legislative session has been productive in the Missouri Senate.

“Things are tenuous right now. A couple of bills that my caucus doesn’t care a whole lot for have passed. Also, SJR 39 was a very traumatic experience for the Senate,” said Keaveny.

That resolution would ask voters whether religious organizations and businesses should be protected from penalties for refusing to offer goods and services for same-sex marriages. Democrats filibustered it for more than a day and a half. The measure passed in the Senate and is in the House.

Keaveny said the budget will be one of the main priorities during the second half of the session. He wants a larger investment in the state budget for mental health and higher education.

“I know there was a $1 million cut from some of the neighborhood mental health centers. I think we need to reinstate that,” said Keaveny.

A mental health liaison program was created in Missouri a couple of years ago and Senate Keaveny thinks it should be strengthened.

“There’s an absolute shortage of beds for mental health patients. Some of these hospitals have mental health patients sleeping in corridors,” said Keaveny.

“So often, people with mental health just don’t know where to turn. The liaisons are providing a very important service.”

Keaveny also calls the cuts to the University of Missouri and some of the other state colleges and universities ‘drastic’.

“I think the cuts are shortsighted. I think we need stop and think about what we’re doing. The end result is going to be an increase in tuition and would make college education less affordable for students or put the students further in debt,” said Keaveny.

The Missouri House has passed a budget that cuts $7.6 million from Mizzou’s administration. Supporters of the cuts argue that students will not be impacted by the cuts to the University of Missouri.

Governor Jay Nixon’s budget request calls for a nearly $56 million boost in higher education performance funding. The House reduced that increase to 2% for all colleges and universities except Mizzou, and that would only be funded if revenue increases as much as Nixon predicts.

The Senate is expected to work on the budget when lawmakers return from spring break.

U.S. Senate supports McCaskill’s measure to hold Backpage in contempt

(Missourinet) – The National Center for Missing & Exploited Children says more than 71% of child sex trafficking reports are connected to ads on Backpage.com. Missouri U.S. Senator Claire McCaskill’s resolution has received unanimous support in the U.S. Senate to hold the company in contempt for failing to honor two subpoenas issued by a Senate committee. The subpoenas call for information on Backpage’s business practices and policies for preventing the trafficking of children.

McCaskill’s measure also cleared the Committee on Homeland Security & Governmental Affairs by a unanimous vote last month. The Senate’s Legal Counsel can now bring a suit in the U.S. District Court for the District of Columbia to ask the court to directly order compliance with the subpoena.

“I find it shocking that a company would refuse a lawful subpoena of the U.S. Senate, would ignore a lawful subpoena of the U.S. Senate. It’s particularly outrageous give that Backpage has already admitted that serious criminal activity, including sex trafficking of children, occurs on its site,” said McCaskill.

“It’s refused to willingly cooperate. It has refused two legitimate and dually-authorized subpoenas asking for information at the heart of the investigation concerning Backpage.”

McCaskill and Ohio U.S. Senator Rob Portman, the panel’s Republican Chairman, led a Senate hearing in November to target online sex trafficking, particularly trafficking of children, and demanded answers from Backpage. Carl Ferrer, Chief Executive Officer of Backpage, failed to obey a subpoena compelling his attendance at that hearing.

“If we ignore Backpage’s refusal, what does that say to companies in the future, where we need information in order to do our job? That you can give the back of your hand to the U.S. Senate and there will be no consequences? Obviously that’s a slippery slope I don’t think we should go down,” said McCaskill.

The last time the Senate has held anyone in contempt was in 1995.

Man convicted of 1977 murder of Brentwood teen dies in Missouri prison

A man once sentenced to death for the 1977 murder of a Brentwood teenager has died in prison.

Gregory Bowman was convicted of kidnapping, raping, and killing 16-year-old Velda Joy Rumfelt. His death sentence was set aside in 2011 after the state Supreme Court ruled jurors improperly heard information about two Illinois murders Bowman had been sentenced to life for. He was set free in those cases after a court threw out his confession.

Prosecutors as recently as last year were pursuing a new penalty phase against Bowman, intending to again seek the death penalty. DNA evidence linked him to Rumfelt’s murder.

Bowman, 64, was reported last year to be terminally ill. The Department of Corrections says his death appears to be due to natural causes.
