No charges in Nodaway County infant shooting death

Nodaway County Sheriff patchELMO (AP) – A Nodaway County panel that reviews child fatalities is recommending that no charges be filed in the accidental shooting death of a 9-month-old boy by his 5-year-old brother.

Nodaway County Prosecutor Robert Rice said Wednesday the county’s Child Fatality Review Board made the recommendation after reviewing Monday’s death at a home in Elmo.

Investigators said the victim’s 5-year-old brother found a .22-caliber Magnum revolver in a bedroom and fired it, hitting the baby, who was in a playpen. The child died at a Kansas City hospital.

Sheriff Darren White said the boys’ mother was at the house with her four children at the time.

The Maryville Daily Forum reports Rice will make the final decision on criminal charges. He said the panel’s recommendation will figure prominently in his choice.

WASHINGTON – U.S. Senator Claire McCaskill, a senior member of the Armed Services Committee, today met with former Deputy Secretary of Defense, and nominee for Secretary of Defense, Dr. Ashton Carter, ahead of his confirmation process in the Senate.

“The world’s greatest military needs great leadership at its helm to take on not only the immense threats we face as a nation from extremists like ISIL, but also to tackle system-wide issues like sexual assault and military spending,” McCaskill said. “I’ve worked with Dr. Carter in the past to increase oversight of wartime contracting, and with his far-reaching practical and academic experience in defense issues, I’m confident he can continue to improve accountability in our military while meeting the challenges we face abroad.”

 

Dr. Carter holds a B.A. in both physics and medieval history from Yale University, a Ph.D. in theoretical physics from Oxford University where he was also a Rhodes Scholar, and chaired the International and Global Affairs faculty at Harvard. In addition to serving as the Deputy Secretary of Defense from 2011-2013, Dr. Carter has served as the Under Secretary of Defense for Acquisition, Technology and Logistics from 2009-2011, and is the four time recipient of the Department of Defense Distinguished Service Medal.

Patriots coach says he doesn’t know how balls were deflated

FOXBOROUGH, Mass. (AP) — Patriots coach Bill Belichick says he doesn’t know how footballs became deflated during the game that got his team to the Super Bowl.

But Belichick declined to answer questions Thursday after saying he knew nothing about accusations that his team cheated with underinflated footballs in its win against the Colts in the AFC championship game.

The NFL is investigating.

Belichick says quarterbacks, kickers and other specialists have their own preferences on footballs. But he says he gives them no sympathy when they talk about those preferences, and forces players to practice under bad ball conditions.

Belichick says the Patriots going forward will inflate footballs to a safe level to prevent them from going under allowable air pressure during games.

Patriots quarterback Tom Brady is expected to address reporters later Thursday.

Mo. Woman Sentenced for Stealing $300,000 from Employer

embezzelmentSPRINGFIELD, Mo. – Tammy Dickinson, United States Attorney for the Western District of Missouri, announced in a media release on Wednesday that a Galena, Mo., woman has been sentenced in federal court for embezzling more than $300,000 from her employer.

Sarah N. Underwood, 36, of Galena, was sentenced by U.S. District Judge Beth Phillips on Tuesday, Jan. 20, 2015, to two years and six months in federal prison without parole. The court also ordered Underwood to pay $311,280 in restitution to Fall Creek Condominium and $95,008 in restitution to the Internal Revenue Service, for total restitution payments of $406,288.

On March 17, 2014, Underwood pleaded guilty to wire fraud, money laundering and failure to file a tax return. Underwood worked as the community manager for Fall Creek Condominium in Branson, Mo., from Jan. 15, 2007, until she was fired on Sept. 7, 2012, when her theft was discovered. Fall Creek and its owners association has 639 condominiums owned by individuals and under its association. Among other duties, Underwood was responsible for the book-keeping and financial affairs of Fall Creek, and was an authorized signatory on the checking accounts.

Underwood’s wire fraud, money laundering scheme, and tax fraud extended over two years and totaled $406,288 in losses to her employer and the government.

Underwood conducted numerous unauthorized electronic bank transfers and wrote $311,280 in unauthorized checks from the bank accounts of the Fall Creek Condominium Owner’s Association over a two-year period. Underwood also received two paychecks every two weeks from Fall Creek. Underwood deposited these checks into her bank accounts and spent the money on personal expenses and purchasing luxury items.

For example, Underwood admitted that she spent $76,287 to purchase a Shelby Mustang and used $25,505 to purchase a condominium at Fall Creek. Underwood also purchased a 2012 Harley-Davidson motorcycle and a 2012 Yamaha wave-runner.

Underwood used a cashier’s check written on her employer’s bank account to purchase a 2012 Ford F350 Super Duty 4X4 Crew Cab Truck for $56,169. The truck was registered to Mstrmind Enterprises, a company owned by her and her boyfriend, which performed construction and rehabilitation work at Fall Creek. Underwood was responsible for running the business affairs of Mstrmind, while her boyfriend, who was also employed by Fall Creek, was the project manager and responsible for the actual construction or rehabilitation project. The embezzlement scheme included an $80,000 check written to Mstrmind for work that was never performed.

Underwood also admitted that she failed to file federal tax returns for 2010, 2011 and 2012.

According to court documents, after pleading guilty in this case, Underwood became involved in another incident that further casts suspicion on her because of monies from a not-for-profit organization that were in her possession and went missing. On May 13, 2014, the Branson, Mo., Police Department received a report from Biker’s Against Drunk Drivers (BADD) regarding the possible theft of a bank deposit totaling $1,997. Although BADD chose not to proceed with a criminal prosecution, court documents note, Underwood engaged in behavior that placed her under suspicion for theft and fraud while she was facing a sentencing for similar conduct perpetrated against a different victim.

This case was prosecuted by Assistant U.S. Attorney Patrick Carney. It was investigated by the FBI and IRS-Criminal Investigation.

LAWRENCE- The final touches are completed at University of Kansas Anschutz Sports Pavilion for the visit from President Obama.

Students began to form a line to enter the building long before sunrise. The doors open at 8:30 a.m.

The president is expected to speak just before 11:30 a.m.

Obama would be the fourth sitting U.S. president to visit KU, with the last sitting president to visit being William H. Taft in 1911. Presidential spokesman Josh Earnest said Obama wanted to visit Kansas to show that Republican support exists for the types of programs the president supports.

2 Mo. Men indicted for Overland Park bank robbery

KANSAS CITY, KAN. – Two Missouri men were indicted by a federal grand jury Wednesday on charges of robbing an Overland Park bank, U.S. Attorney Barry Grissom said in a media release.

Landein Craddock, 33, Kansas City, Mo., and Jerome Davis, 31, Kansas City, Mo., are charged with one count of bank robbery and one count of brandishing a firearm during the robbery. The indictment alleges that on Jan. 20, 2015, they robbed the Bank of the West at 9400 Antioch in Overland Park, Kan. During the robbery they brandished a revolver.

If convicted, they face a penalty of not less than five years in federal prison and a fine up to $250,000 on the firearm charge, and a maximum penalty of 25 years and a fine up to $250,000 on the bank robbery charge. Grissom commended the Overland Park Police Department, the Leawood Police Department, the Kansas City, Mo., Police Department and the FBI for their work on the case. Assistant U.S. Attorney Scott Rask is prosecuting.

 

Mo. Budget director announces Governor’s new budget proposal

JEFFERSON CITY – Missouri Budget Director Linda Luebbering announced Gov. Jay Nixon’s upcoming budget proposal shortly before his State of the State address Wednesday evening.

In it, Nixon is proposing to have less money in the budget than he did for his fiscal year 2015 budget proposal last year.

Luebbering described the governor’s budget proposal as “modest.”

This time around, Gov. Nixon lowered the overall total from $27.6 billion for fiscal year 2015 to $26.1 billion for fiscal year 2016.

This year, the governor is proposing $150 million in additional funding for local public schools. Last year, KOMU 8 News reported Governor Nixon requested more than $275 million for K-12 schools in Missouri.

The governor has also recommended expanding the state’s Medicaid program. He also recommended an expansion last year, but it did not go through.

The state legislature has until May to pass a budget. The next fiscal year begins July 1.

House GOP drops planned vote on abortion bill

WASHINGTON (AP) — With thousands of anti-abortion protesters in the nation’s capital, Republicans are ready to push legislation through the House designed to please them. But it’s not the bill an embarrassed GOP was hoping for.

Republican leaders were forced late Wednesday to abruptly drop plans for House debate of legislation criminalizing most abortions after 20 weeks of pregnancy. They concluded they were short of votes.

Some GOP women and other lawmakers objected that while the measure allowed exemptions for victims of rape or incest, it only excluded those women who had already reported the crimes to authorities.

They argued that the requirement put unfair pressure on women who have already suffered.

Instead, the House will debate legislation barring taxpayer funding for abortions — a prohibition that’s already largely in place.

Mo. woman hospitalized after Atchison Co. crash

Missouri Highway Patrol  MHPFAIRFAX- A Missouri woman was injured in an accident just after 11 p.m. on Thursday in Atchison County.

The Missouri State Highway Patrol reported a 1995 Pontiac Grand AM driven by Crystal A. Klosek, 29, Fairfax, was eastbound on Route J one mile west of Fairfax.

The driver failed to negotiate a curve. The vehicle crossed the centerline, began to skid, traveled off the south side of the road and struck and embankment.

Klosek was transported to Community Hospital Association in Fairfax.
The MSHP reported she was not wearing a seat belt.
