FBI: suspect threatened to assault U.S. senator from Iowa

FBI agents have arrested an Omaha man who they say made threats against U.S. Senator Joni Ernst of Iowa.

Special Agent in Charge Randall Thysse of the bureau’s Omaha Field Office said Robert William Simet was apprehended for making threats to assault Senator Ernst.

“The safety of our elected officials is something that cannot be taken lightly,” Thysse said.

“We appreciate those people who reported this to the proper authorities and for the response from our partners at the U.S. Attorney’s Office for the Southern District of Iowa for their swift action on this matter,” he said.

Thysse said Simet is in custody, and that he will be transported to Council Bluffs for an initial court appearance there.

Fatal crash under investigation in Trenton

The Trenton Police Department is investigating a crash that killed a pedestrian earlier this week.

According to police, a 48-year-old Trenton woman was killed Wednesday after she was hit by a truck in front of the Plaza Apartments on Main Street around 9:30 p.m.

Police said according to the investigation and witness statement, the woman walked into the path of a westbound 2003 Ford F-150, and was hit by the truck. The truck was driven by a 36-year-old Trenton man.

The woman was transported to Wright Memorial Hospital where she later succumbed to her injuries.

Police said Thursday that at this time the incident is still under investigation.

Motorcyclist in Daviess County crash dies

A motorcyclist from Savannah has died from injuries sustained when his Harley hit a deer on I-35 in Daviess County this week.

The accident happened at 9 pm on Saturday, July 1. A crash report from the Missouri State Highway Patrol indicates Thomas Beaver, 58, was ejected from the bike after it hit a deer in the southbound lanes of the interstate eight miles north of Winston, Missouri in Daviess County.

Beaver was transported by helicopter to the Truman Medical Center. The Patrol confirms that Beaver died at the hospital on Thursday.

Temps in the 80s through Saturday

A cold front will go through the area mid day today, lowering the dewpoints over northern Missouri which will help keep the heat index values below 90 degrees, while south of the Missouri River will still see heat index values in the mid 90s with a slight chance of a shower early in the morning. A much drier Saturday will keep temperatures and heat index values in the upper 80s before the pattern starts to uptick in temperatures and dewpoints Sunday. There is a chance for isolated to scattered thunderstorms Sunday afternoon with heat index values reaching into the mid 90s as a wave of higher heat and humidity start up. Here’s the 7-day forecast from the National Weather Service:

(Update) Shoplifting suspect sentenced to four years in prison for stealing sandwiches.

(UPDATE) A St. Joseph man charged with a felony for stealing sandwiches from a local grocery store was sentenced Friday. Brent Rhyne, was charged for an incident in January, in which he took several sandwiches from the store without paying for them. He has been convicted of at least three stealing offenses in 2013, and has another misdemeanor stealing charge pending.

Rhyne on Thursday pleaded guilty to a class-e felony count of stealing, and expressed an interest in taking part in a drug-treatment program at an Institutional Treatment Center.

On Friday, Circuit Judge Daniel Kellogg sentenced Rhyne to four years under a statute that allows him to retain jurisdiction for 120 days. At that time, Rhyne could be granted probation to continue treatment.

Defendant in high-speed pursuit pleads guilty

A St. Joseph man charged with resisting arrest for fleeing from Drug Strike Force officers was ordered to serve two years in prison.

Jay Bee Baskett, 29, was charged after a pursuit in which he passed several vehicles on a two-way street at high speed on March 10.  The pursuing officers said they called of the search when Baskett pulled out to pass two vehicles and nearly ran a motorist in oncoming traffic off the road.

Baskett pleaded guilty Thursday before Circuit Judge Daniel Kellogg, who ordered a two-year prison term with credit for time already served.

Baskett’s attorney Michelle Davidson raised some serious concerns about the warrant those officers were trying to serve.  The defendant was on probation in an unrelated 2013 drug case at the time of the pursuit.  Davidson examined Scott Adams with the Missouri Division of Probation and Parole about the earlier case, in which the DOC either misread or lost the documents, and mistakenly filed a warrant for a parole violation.  Baskett was on probation, not parole, but that didn’t stop authorities from taking him back into custody without a hearing.  Davidson told the judge her client had been imprisoned twice, for 526 days, without due process.

That other case actually came up for a probation violation hearing June 2 before Circuit Judge Patrick Robb, who ruled that the probation period had expired.

Lawyers in the case point out that an invalid warrant is no defense to the separate crime of resisting arrest.

 

Andrew County hog farm regulations won’t go to trial

A judge has ruled regulations passed by the Andrew County Health Department to be invalid and unenforceable in regards to a hog farm operation north of Savannah.

According to court documents, on Wednesday, Andrew County Judge Randall Jackson found the ordinance enacted by the Andrew County Health Department in 2010 on Concentrated Animal Farming Operation (CAFO) to be invalid. The court found that Missouri law does not give county health center boards the authority to pass regulatory ordinances such as the CAFO ordinance, but that only county commissions have the authority to pass broad-sweeping regulatory ordinances and only in compliance with state law.

The suit, originally filed by the health department against Joseph and John Knoff, Stone Ridge Pork and G.J.L. Farms, L.L.C. will not be going to trial. Court documents stated that since the ruling is dispositive of the case, the court found it unnecessary to address other grounds raised by defendants in attacking the validity of the ordinance. The Court also ruled that court costs should be taxed against the Andrew County Health Department.

A final judgement is expected to be issued on or by July 17.

St. Joseph City Hall turns 90

The City of St. Joseph is celebrating 90 years at its current City Hall location with a public photo gallery display.

According to a news release, the building is of an Italian Renaissance Revival style and features a concrete balustrade loggia on the second level, engaged columns, arched openings, and a red tile hipped roof. The marble used was quaried in Missouri. The pink marble came from south of St. Louis and the gray from Carthage. The walls of the building are 12 inches thick and there are 12 vaults located in the building. The fixtures are solid bronze as are the six entry doors on the north and south sides of the building. Construction of the building started in 1926, took approximately 16 months to build, and was designed by the architectural firm of Eckel & Aldrich.

The old City Hall building was located in Market Square. On July 7 1927, a parade of around 400 people walked from the old building to the current location at 1100 Frederick Avenue as part of a dedication ceremony.

The city said a photo gallery will be on display in the lobby of City Hall beginning Friday and be up through July 28. After that, the framed photos will be permanently hung along the hallway of the second floor of City Hall.

Reward offered for man suspected of four bank robberies

The FBI, along with local and state officials in Nebraska, continue their search for a fugitive who is a suspect in four bank robberies in Nebraska and Iowa.

A notice to be on the lookout for Tyree Carney, 24, was issued last week. Authorities say Carney may be driving a stolen 2004 Tan/Gold Honda Accord 4D, bearing Nebraska license tag number UNP290. Officials say Carney should be considered armed and dangerous. They urge you not to try to apprehend him, but rather to call 9-1-1.

An investigation continues by the FBI, the Omaha Police Department and the Pottawattamie County Sheriff’s Office. If you have information that could help, you are urged to contact Omaha Crime Stoppers at (402) 444-STOP, or online at www.omahacrimestoppers.org.
