Cameron man seriously hurt in early morning crash

Investigators believe DWI may be involved in a crash early Saturday morning east of Altamont in Daviess County. The driver and sole occupant was seriously hurt in the crash.

In an online report, the Missouri State Highway Patrol said Joshua Detherage, 23, of Cameron, was arrested for Driving While Intoxicated but released for treatment at Liberty Hospital.

A crash report says Detherage was driving west on Missouri Highway Six shortly after 2 am Saturday when his pickup left the roadway. Investigators say the driver overcorrected, and the vehicle crossed the roadway, hitting a tree and rolling over along the south side of the roadway. The report indicates Detherage was not wearing a safety device.

Kansas AG elected president of National Association of Attorneys General

Kansas Attorney General Derek Schmidt is now the president of the National Association of Attorneys General (NAAG).

As president, Schmidt will lead the national organization of 56 state and territorial attorneys general for the next year.

“This is a tremendous opportunity to put the interests of Kansans front-and-center on a national platform,” Schmidt said. “The National Association of Attorneys General helps state and territorial attorneys general engage in serious work to solve serious problems. I am grateful to my colleagues around the country for giving me this chance to lead.”

As president, Schmidt will have the opportunity frame a presidential initiative to focus the association’s work for the next year on a topic of particular interest. He said he will announce the subject of his presidential initiative after the Fourth of July holiday. In recent years, presidential initiative subjects have included human trafficking, consumer privacy and promoting child safety.

NAAG serves as a non-partisan forum for attorneys general to discuss and work together on issues of common interest. The organization also provides training and instruction to help state attorneys general build and maintain professional staff, assists states in ongoing implementation of the 1998 Tobacco Master Settlement Agreement, and helps coordinate multi-state investigations involving consumer or Medicaid fraud.

The nation’s state and territorial attorneys general unanimously elected Schmidt their president Thursday at the NAAG annual summer meeting in Big Sky, Montana. Schmidt is the fourth Kansan to serve as NAAG president since the organization was founded in 1907. The others were Harold Fatzer (1952-53), Robert Stephan (1985-86) and Carla Stovall (2001-02).

Schmidt has served as Kansas Attorney General since 2011. He is a native of Independence, and holds a law degree from Georgetown University, a master’s degree from the University of Leicester in the United Kingdom, and a doctorate from the University of Kansas School of Law. Before being elected Kansas Attorney General, Schmidt, 49, served as Kansas Senate majority leader and as an assistant to Governor Bill Graves and U.S. Senator Nancy Landon Kassebaum.

He and his wife, Jennifer, have two daughters.

Platte County to take part in National Fourth of July crackdown

(News release) – The Northland DWI Task Force, which includes the Platte County Sheriff’s Office, will be out in full force starting June 30th as part of the annual nationwide Fourth (4th) of July Holiday “Drive Sober or Get Pulled Over” substance-impaired driving crackdown.

The crackdown, which will include high-visibility and high-saturation enforcement throughout Platte and Clay counties, will run from June 30-July 4, 2017.

The effective nationwide substance-impaired driving crackdown will include high-saturation and high-visibility enforcement and will be supported by national paid advertising, creating a comprehensive campaign to curb substance-impaired driving over the Fourth (4th) of July Holiday.

The agencies of the Northland DWI Task Force have joined together and their officers and deputies will be aggressively looking for substance-impaired drivers during the crackdown and will arrest anyone caught driving impaired.

Although it is illegal in all 50 States, the District of Columbia, and Puerto Rico to drive impaired (having a blood alcohol concentration of .08 or higher), far too many people across the nation get behind the wheel after consuming too much alcohol. Not only are alcohol impaired drivers a threat to others, new statistics from the National Highway Traffic Safety Administration (NHTSA) indicate drugged driving has now surpassed drunk driving in fatal crashes. NHTSA’s research shows in 2015, drugs were present in 43% of the fatally-injured drivers more frequently than alcohol was present.

“Every year, about one-third of all motor vehicle traffic deaths involve one or more substance-impaired drivers or motorcycle operators,” said Platte County Mark Owen. “In 2016, 233 people were killed and 700 seriously injured on Missouri’s roadways in crashes that involved at least one substance-impaired driver.” That works out to approximately one substance-impaired driver involved fatality every 1-3/4 days. Sheriff Owen added that the Fourth (4th) of July Holiday is particularly dangerous. During the Fourth (4th) of July Holiday July 1-4, 2016, two (2) people were killed and ten (10) were seriously injured involving at least one substance-impaired driver.

“Research has shown that high-visibility enforcement like the ‘Drive Sober or Get Pulled Over’ campaign reduces substance-impaired driving fatalities by as much as 20 percent. By joining this nationwide effort, we will make the Northland roadways safer for everyone throughout the holiday,” said Chief Thomas Carey, Kearney Police Department.

“We want to remind everyone that getting behind the wheel impaired is a terrible idea. Unfortunately, not only does being under the influence impair your ability to operate a vehicle safely, it also impairs your judgment and good sense about whether you can, or should drive. If you have any doubt about your sobriety, do not get behind the wheel. If you do chose to drive impaired, you will be arrested. No warnings. No excuses.” Excelsior Springs Police Chief Clinton D. Reno said.

Smithville Police Chief Jason Lockridge noted that being arrested for driving under the influence of any substance brings a wide range of negative consequences into one’s life. Substance-impaired drivers face jail time, loss of their driver’s license, and steep financial consequences such as higher insurance rates, attorney fees, court costs, lost time at work, and the potential loss of their job. When family, friends, and co-workers find out, violators also often face tremendous personal embarrassment.

“Driving while impaired is simply not worth the risk. So don’t take the chance. Remember, we will be out in force and we will be watching, so ‘Drive Sober or Get Pulled Over.'” said Chief Chris Skinrood, Riverside Police Department.

A man received a life sentence as a predatory sex offender in Platte County after sexually abusing a 10-year-old girl.

Shannon Langley, 35, was sentenced Thursday after pleading guilty that same day in Platte County Circuit Court to statutory sodomy in the first degree and enticement of a child.

In addition to the victim in Platte County, prosecutors also showed that Langley had abused several other children in Jackson County. Prosecutors used those other criminal acts to charge Langley as a predatory sexual offender under Missouri law. The seldom-used provision requires a life sentence for offenders who commit multiple serious sexual offenses.

Platte County Prosecuting Attorney Eric Zahnd said, “We used every tool the law gives us make sure that this defendant has molested his last child. His days of hurting kids are finally over.”

Langley has two pending cases in Jackson County. In one, he is charged with sexual misconduct involving a child. In the second, he is charged with three counts of statutory sodomy in the first degree. Platte County prosecutors used the facts of those cases to secure the life sentence.

Deputy deploys taser at man allegedly armed with knife

Nathan Osborne

The Livingston County Sheriff’s Office said a man allegedly armed with a knife was tazed Thursday after refusing to show his hands to a deputy.

Sheriff’s Steve Cox said Thursday afternoon a Missouri Parole Officer was on U.S. 36 and located Nathan Osborne, 30 from Chillicothe who had an outstanding Chillicothe Municipal warrant for possession and a warrant for child neglect from Buchanan County. Cox said Osborne ran into the brush and timber to elude law enforcement officers.

Later that day, around 6:50 p.m. Cox said a deputy located Osborne walking on U.S. 36 west of Chillicothe.

“The suspect was now also wanted on a Probation Violation Arrest Warrant,” Cox said. “Upon approaching the area Mr. Osborne took off running towards the timber.”

Cox said the deputy yelled at Osborne and chased after him.

“Osborne tripped and fell in the timber area and refused orders to show his hands. The suspect would only show his left hand and kept his right hand hidden from the deputy,” Cox said. “The Taser was properly deployed and the deputy then saw a large knife near where the subjects’ right hand was. The suspect continued to ignore commands from the deputy to roll away from the knife and was told he would be Tazed again if he did not comply. The suspect rolled away and was handcuffed and ultimately transported to Hedrick Medical Center to be cleared for confinement.”

Osborne was transferred to the Daviess Dekalb County Regional Jail. Cox said additional charges may be filed.

Caregiver pleads guilty to stealing patient’s credit card

A 32-year-old St. Joseph caregiver pleaded guilty Friday to charges she stole a patient’s credit card and used it to pay her water bill.

Ashley Garr pleaded guilty to one count of receiving stolen property.

As we reported, Garr was accused in March of using an 86-year-old woman’s credit card information to pay for her own Missouri American Water Bill, totaling more than $1,000.  In court Friday, Garr told Circuit Judge Patrick Robb that she found the card on the floor, took it, and used it.

Assistant Prosecuting Attorney Joshua Bachman said the victim had loss protection on the card, so she lost nothing.  But the bank is still owed the money.  Judge Robb said he would be “impressed” if Garr had that paid off before sentencing, now scheduled August 14 at 2 pm.  Garr will also owe more than $300 in court costs.

The crime occurred in December of last year, before the General Assembly consolidated the sentencing rules in Missouri, and increased some of the penalties.  Receiving stolen property is a class-c felony, which in this case carries a maximum sentence of seven years in prison.
