Spitting incident lands man in jail without bail

Gary House
A 27-year-old St. Joseph man is being held without bail for allegedly spitting in a woman’s face.

That, and allegedly kicking in her back door landed Gary House in jail June 16.

The misdemeanor complaint accuses House of domestic assault in the 4th degree “…by spitting in her face,” knowing that she “…would regard such conduct as offensive.”

According to the probable cause statement, House spit in her face twice, but the woman was able to lock the defendant out of the house for her safety. The affidavit says he then “…kicked the rear door completely off the door frame.”

Court documents say House is currently on parole, and describe him as a “multi state offender and convicted felon.”

House appeared in court Tuesday before Associate Circuit Judge Keith Marquart. The court found the defendant is a danger to the victim and denied the setting of bail. A trial-setting is scheduled July 27 at 4 pm. House said he would apply for a public defender.

Judge denies bail request for suspect in porch bombing

Edward Catron

A judge on Tuesday refused to set bail for a 19-year-old St. Joseph man accused of setting off a bomb on the front porch of a St Joe home last month. Edward Catron is charged with knowingly burning or exploding, a class-e felony for allegedly detonating an improvised explosive device at 2402 NE Parkway on May 29.

Damage was in the tens of thousands of dollars, though no one was injured.

Catron was scheduled for a preliminary hearing Tuesday, which was waived by his lawyer. Defense attorney Andrew Parmenter also asked the court to set bail, which has been denied up to now.

Parmenter pointed out that the Catron has no felony convictions and is not a flight risk. Parmenter said his client is willing to submit to electronic monitoring or house arrest if ordered.

But Prosecuting Attorney Dwight Scroggins opposed the motion, pointing out that investigators found evidence of drug use in the defendant’s house, as well as explosive materials, a recipe for a bomb, firearms and live ammunition. Scroggins said the only indication of motive they’ve found was retaliation, for what Scroggins called a “fairly innocuous” occurrence a few weeks earlier, between Catron and one of the residents of the house.

“We’re not talking about fireworks,” Scroggins said. “This was a legitimate explosive device.” Scroggins said this was not a random act, but an intentional response to the earlier incident.” Scroggins asked Associate Circuit Judge Keith Marquart deny the request to set bail.

Marquart agreed, calling it a “totally inappropriate, outrageous reaction.” Judge Marquart ruled that Catron continues to present a danger to the victims and the community, and denied bail. Catron remains in custody awaiting formal arraignment in Circuit Court before Judge Daniel Kellogg June 22 at 8:30 am.

St. Joseph man hit and killed by train in Independence

The Independence Police Department has identified the victim of a train versus pedestrian incident from last week as a St. Joseph man.

20-year-old Da’Jour J. Lucas was identified Monday as that victim. According to a news release, on June 14 shortly before 4 a.m. officers with the Independence Police Department were called to a pedestrian hit by a train on the railroad tracks under Missouri 291 Highway north of E. 39th St. When officers arrive they located Lucas deceased.

One of the southbound Missouri 291 Highway lanes was shut down during the morning commute temporarily while police detectives and personnel from the Medical Examiner’s Office were on scene.

According to a post on the department’s Facebook page, the case is still an open investigation.

Suspect in decades-old child-sex case appears in court

Lewis Marshall

A man charged with one child-sex crime, and under investigation for several more, will remain behind bars without bail. Details are emerging from an ongoing investigation into the 57-year-old Albany, Mo. man accused of sexually-molesting children, some of them at gunpoint, some of them nearly 30 years ago.

Lewis Marshall is charged in Buchanan County with sodomy for the alleged abuse of a five year old over the course of three years starting in 1990. But investigators warned in court documents of at least six other victims in multiple jurisdictions in Northwest Missouri.

During Marshall’s initial court appearance Tuesday, Assistant Prosecuting Attorney Kristina Zeit told Associate Judge Keith Marquart there are numerous other victims, including family victims and non-family victims.

An investigator for the Missouri State Highway Patrol said in a probable cause statement that he has identified six sexual-assault victims, all of them children. Trooper K. Schrage said in the court filing that the victim in the Buchanan County case received a death threat if he ever told. The document also said “it has been reported several times that the defendant used a firearm in the perpetration of his sexual crimes.”

Judge Marquart ordered that Marshall continue to be held without bail as a danger to the victim. Marshall is scheduled for a preliminary hearing July 7 at 11 am.

Bail denied in firearms case

Christopher Sands
A man facing an unlawful firearms charge, after allegedly firing one inside a home, discovered Tuesday he will be held without bail.

Christopher Sands was arrested for an incident June 16 and charged with unlawful possession of a firearm, because of a prior felony robbery conviction. Investigators said in an affidavit that Sands “…possessed a .22 caliber handgun on his person in his waistband,” and that he “…shot the .22 caliber handgun off inside of the residence.”

Bail for the defendant was originally set at $25,000. During his first court appearance before Judge Keith Marquart, details emerged of the argument and fight with his brother and girlfriend that allegedly led to the gunfire.

Judge Marquart ruled Sands poses a danger to both victims and denied the setting of bail.

The case is now scheduled for a preliminary hearing July 7 at 11 am, with a status hearing planned next week.
