Shooting suspect to remain behind bars

A man accused of shooting at witnesses who say they spotted him in a stolen car will remain in jail as he awaits his next court appearance.  As we reported, Zachary Bixby is charged with unlawful use of a weapon after the incident on U.S.Highway 59 on April 8.

Court documents filed in the case assert that Bixby and another man were spotted at a business on King Hill Ave. by two witnesses, who said they knew the vehicle he was driving was stolen.

The witnesses pursued the vehicle to a location in the 9000 block of south 59 Highway, but the vehicle had pulled over and several shots were fired at the witnesses’ vehicle. According to the probable cause affidavit, one round hit the vehicle on the hood.

Bixby then allegedly fled on foot to a residence nearby, entered the home, threatened the homeowner at gunpoint, and took a pickup truck. He allegedly drove into a field where the truck got stuck in the mud. Investigators say Bixby was arrested a shot time later and a search turned up a handgun.

The other man was arrested but has not been charged.

This is not Bixby’s first brush with the law.  He has been booked into the Buchanan County Jail several times, on charges including parole violation, possession of a controlled substance, and failure to appear.

During Bixby’s first court appearance on Tuesday, Buchanan County Associate Circuit Judge Keith Marquart denied bail, ruling that the defendant continues to pose a danger to the community. Judge Marquart entered a plea of not guilty and scheduled a preliminary hearing April 28 at 11 a.m. Bixby will apply for a public defender.

Bixby is also charged in Clay County with first-degree robbery and armed criminal action after a shoplifting incident in Gladstone. Court documents in that case accuse him of trying to drive another stolen vehicle into a uniformed police officer trying to apprehend him.  Click here for more.

Interstate 35 work planned

wpid-modot-logo.jpgBETHANY, Mo. – Pavement repairs are planned for a section of Interstate 35 in Daviess and Harrison counties.

On Wednesday, April 12, crews Herzog Contracting Corp., working with the Missouri Department of Transportation, will begin pavement repairs between Pattonsburg (mile marker 78) and Eagleville (mile marker 106). Repairs are planned in both the north and southbound lanes. Throughout the project, however, one lane of each direction will remain open.

Crews will work daylight to dark Monday through Saturday for the duration of the project. Some lane closures may remain in place overnight. This project will continue through April 21, weather permitting.

Motorists should be alert and follow all construction signs and message boards. All work schedules are subject to change. MoDOT encourages all motorists to slow down, buckle up, eliminate distractions and drive safely through work zones to ensure everyone is able to Arrive Alive.

Catch and release fishing at Krug Lagoon begins this week

parks deptThe City of St. Joseph Parks, Recreation and Civic Facilities Department announced that the spring fish stocking and grand opening of the Krug Park Lagoon takes place this week. 

The Missouri Department of Conservation will be stocking Krug Lagoon with 450 hybrid bluegills and 175 channel catfish. Children are invited to attend to see, touch and learn about the fish before they are placed into Krug Lagoon at 10:30 a.m. on Wednesday. 

The public is invited to join the Missouri Department of Conservation and the St. Joseph Parks Department as they open Krug Lagoon for catch and release fishing. The Krug Lagoon Opening Day Ceremony is scheduled to take place from 1 to 3 p.m. on Saturday, April 15. 

The Missouri Department of Conservation will have rods, reels, and bait available for those who need to borrow equipment.

Beginning at the opening day ceremony, catch and release only fishing will be allowed daily from sunrise to sunset.  Anyone 15 years of age or under, anyone 65 or older, or anyone who meets the other Missouri Department of Conservation requirements for not needing a lifetime, annual or daily fishing permit, do not need to purchase a fishing permit unless they are trout fishing. Adults between the ages of 16 and 64 will need to obtain a fishing permit before casting a line. Fishing permit information may be obtained online and permits may be purchased online through the Missouri Department of Conservation’s website

Man charged after shots fired in midtown neighborhood

A Chicago man is accused of firing a handgun at people in a St. Joseph neighborhood.

Martell Jenkins, 32 is charged in Buchanan County with a felony of unlawful possession of a firearm.

Capt. Jeff Wilson with the St. Joseph Police Department said officers responded to the 900 block of S. 15th St. Sunday around 2:20 p.m. in reference to a call of shots fired. Wilson said witnesses reported that a white passenger vehicle occupied by at least four subjects was parked in the street. He said it was further stated that two of the people in the vehicle fired shots at two houses in that block. Wilson said the vehicle then left the area. Officers recovered shell casings at the scene.

According to court documents, Det. Blaine Seymour with the St. Joseph Police Department said a witness stated Jenkins fired a handgun during a disturbance at two people in the street in that area.  Seymour said shortly after midnight officers responded to an apartment in the 2400 block of Francis where Jenkins was located and found a pistol.  Court document stated Jenkins is from the Chicago area and has plans to return to that area.

Jenkins is currently being held without bail in the Buchanan County Jail.  He’s due in court Friday for an arraignment.

(Update) – Police make arrest in early morning shooting investigation

(Update 2:30 p.m.) – The St. Joseph Police Department said a man is in custody after another man was found with a gunshot wound early Monday morning in the 800 block of North 9th.

Capt. Jeff Wilson said officers responded to the 100 block of N. 16th St. shortly before 3 a.m. to investigate a call of shots fired.

“At that time officers recovered multiple shell casings. Within the same time frame we responded to the 800 block of North 9th in reference to a subject that was down,” Wilson said.

Officers located a 35-year-old man who had sustained two gunshot wounds.  Police have since taken a 37-year-old man into custody in connection with the shooting investigation.  As of 3 p.m. Monday charges had not been filed.  Wilson said detectives are continuing to investigate the incidents.

According to Sgt. Steve McClintick, the first call came in around 2:45 a.m. Monday reporting shots fired in the 100 block of North 13th. A few minutes later, another call came in about a man with a gunshot wound in the 800 block of North 9th. McClintick said a 36-year-old male suffered a non-life threatening injury and the man did not offer information as to what happened or where.

McClintick said it’s unknown yet if the calls are related. The incidents are still under investigation.

Smithville man charged with sex crime against 5-month-old boy

A 19-year-old Smithville man is charged with a sex crime against a five-month-old boy.

Brent Porter is charged in Clay County with statutory sodomy. In a court filing, a police detective says the baby was taken to Children’s Mercy Hospital for treatment of injuries and the mother said the youngster had been sexually molested.

According to the affidavit, Porter was caught in the act by the child’s mother.

The child’s 14-year-old mentally disabled brother was in the room at the time, but officials say he is severely disabled and non-verbal, and thus could not tell her what had happened.

Police later found Porter at his step-mother’s home, and took him into custody for questioning. The affidavit asserts that Porter was “…initially deceptive and claimed to have only been changing the baby’s diaper. The mother provided police with information contradicting that. She said there was no new, clean diaper present, that the diaper on the child was clean, and that Porter “never changes her children’s diapers.”

The mother also told police she heard the child screaming, “…a scream unlike she has ever heard” from the baby.

In the affidavit, police say Porter admitted having an erection and being “a little bit horny.”

The examination at Children’s Mercy was not conclusive. The nurse who conducted the exam said the child’s symptoms “…may be related to a medical condition, child sexual abuse, or another mechanism.” The nurse said more information was needed to make a determination. Police say additional evidence is being sent to a crime laboratory for analysis.

Porter appeared for an arraignment Monday.  A plea of not guilty was entered and the case was continued to April 25.  He remains behind bars on $400,000 cash only bail.

She was born November 10, 1940 in Grant City, Missouri daughter of the Vera & Delbert Miller. She owned and operated several Thrift Stores, and she also worked at Interserv. She loved sewing, quilting, working puzzles, playing bingo & the lottery. She also loved spending time with her grandchildren. She was a member of the Patee Park Baptist Church. Beverly was preceded in death by her parents, husband, Lawrence Norris, daughter Christina Mansfield, sisters, Marilyn Mallory and Roberta Kent, and brother, Delbert Miller. Survivors include; daughters, Vickie Sill, Wathena, KS and Tammy Mansfield, son, Harvey Mansfield, St. Joseph, MO, 13 grandchildren: Crystal Parker, Nicole Sill, Carrie Throckmorton, Michael Alvarez, Macklin Fleshman, Josh Parker, Toshia Mansfield, Jayden, JR, Lillian Mansfield, Hope Crossfield, Carlton & Zack Mansfield, 34 great grandchildren, sister, Shirley Whitten, St. Joseph, MO, and cousin who was like a daughter, Fern Marie Miller. A Memorial Service will be held Wednesday, April 12, 2017 at 3:00 PM at the Rupp Funeral Home. The family will receive friends from 1:00 PM – 3:00 PM on Wednesday at the Rupp Funeral Home. She will be cremated under the direction of the Rupp Funeral Home.

He was born December 6, 1951 in Sioux City, Iowa son of Jeanette & Donald Stowers. He married Gayle on May 17, 1997, and she survives of the home. He graduated from East High School, and attended one year of college. Randy worked as a manager with National Beef Leathers in St. Joseph, MO. He enjoyed hunting, fishing, and all sports, and he was an avid daily weight lifter. He was a member of the Evolution United Methodist Church. Randy was preceded in death by his father, Donald Stowers. Survivors include wife, Gayle Stowers of the home, mother, Jeanette Stowers, Sioux City, IA, daughter, Abby Jo (Jeffrey) Brown, Fort Worth, TX, sons, Ryan Beach, Caledonia, IL, and Devin Beach, Baltimore, MD, granddaughters, Harper, Kendall, Kenzie, and Larkyn, brother, Ron (Mary Jean) Stowers, sister, Lori (Greg) Tichenor, and his black lab, Tess, and cat, Amber. The family will receive friends from 2:00 PM – 4:00 PM on Sunday at the Rupp Funeral Home. A Memorial Celebration of Randy’s life will be conducted at 6:00 PM Monday, at the Evolution United Methodist Church, 202 West Hyde Park, St. Joseph, MO. Robert B. “Bob” Davis
1930-2017

Robert B. “Bob” Davis, 86, of rural Hiawatha, died Friday evening, April 7, 2017, at the Sabetha Manor.
Born October 15, 1930, at St. Joseph, MO, one of two children born to Albert and Ferne Syster Davis. Bob wrote: “After much deliberation, my parents brought me back to the farm home 2 ¼ miles east of Hiawatha where except for brief periods of time, I lived my entire life. I suppose it could be said I didn’t get far in this world.” Bob attended the LaGrange country school for 6 years prior to graduation from Hiawatha High School.
Robert belonged to the Mt. Zion Rustlers 4 H Club of Hiawatha. While in 4 H, he constructed the first terrace on his parents’ farm and won the state soil conservation award. He also accompanied the Brown County Soil Conservation Board as a winner of the Goodyear Soil Conservation award for outstanding work in Brown County. The winners received a weeklong trip to Goodyear’s Litchfield Park in Phoenix, AZ.
Robert enlisted in the 2 BN, 130 FA, Kansas Army National Guard of Hiawatha, as a private, later received a commission and completed training as an army aviator in 1956, where he served for 12 years before being discharged. He started flying when he was 20 and enjoyed this sport for over 53 years and received his commercial license in 1956.
Mr. Davis was a longtime member of Bethany United Church of Christ of Hiawatha where he served on the board, and as consistory president; BPOE #1741, Hiawatha Elks Lodge; the Hiawatha Lions Club; and had served on the Wolf River Watershed Board through the years. Bob loved to help and do for others, especially those in need.
On July 3, 1955, he married Evelyn Crane from Powhattan. To this union two children were born: Greg and Kim. The family farmed and operated a dairy on the same farm east of Hiawatha until he and Evelyn retired. Evelyn survives of the home.
Other survivors include his children Gregory Davis (Diane), and Kimberly Neibling (Gary), all of Hiawatha; a sister Bette Lukert (John) of Sabetha; 6 grandchildren: Ryan Davis, Jillian Hefner (Josh), Cody Neibling, Zach Perry, Allison Jackson (LaShawn), Rachel Henninger (Daniel); and 4 great-grandchildren: Ty Jackson, Makayla Neibling, Neaka Henninger, and Draven Henninger.
He was preceded in death by his parents; and a grandson Deivid Davis.
A Celebration of Bob’s life is planned for 10:30 a.m. Thursday, April 13, at Bethany United Church of Christ of Hiawatha, with Pastor Shane Spangler officiating. Private inurnment will be at a later date at Mt. Hope Cemetery, Hiawatha. Military honors a courtesy of Brown County Veterans Honor Guard.
The family will meet friends from 6 until 7:30 Wednesday evening, at Chapel Oaks Funeral Home, Hiawatha.

James Perry Chilcoat
1950-2017

4186964_wlppJames Perry Chilcoat, 67, of St. Joseph, Missouri passed away Friday, April 7, 2017 in Mosaic Life Care Hospital. He was born January 27, 1950 in St. Joseph, MO, son of the late Virginia and Lovell “Chili” Chilcoat. He married Barb Mueller on July 22, 1974, and they have shared 42 years together. He served in the Army during the Vietnam War. He worked at Johnson Controls for 38 years. James enjoyed Sci Fi, and was a fan of the Supernatural, Aliens & Big Foot. He also was an avid gamer on X-Box, especially Golf, and enjoyed collecting cast iron miniature statuettes, bowling, pinball, and fishing. He loved his family, and spending time with his grandchildren . He was a practical joker on his family & friends, and had an ornery streak. James was preceded in death by parents, and a brother, Harold Chilcoat. Survivors include, wife, Barb Chilcoat of the home, step mother, Edna Chilcoat, St. Joseph, MO, daughter, Lisa (Mark) Jenkins, Faucett, MO, sons, Perry (Julie) Chilcoat, Agency, MO, Tony (Antonette) Chilcoat, Kansas City, MO, and Brad (Deanna) Chilcoat, Savannah, MO, grandchildren, Nick, Mike, Katie, Amy, Cheyanne, Abby (Big Foot), Malachi, Isaac, and Serena, brothers, Danny Chilcoat (Joyce Meeks), Lonnie Chilcoat, and Steve (Rose) Chilcoat, sisters, Sandy (Jim) Lawrence, Loretta (Danny) Fisher, Helen Linder, Laura (Josh) Stines, sister in law, Vicky Chilcoat, step sister, Sandy (Pat) Wolf, step brothers, Mike (Barb) Young, Paul (Terry) Young, 8 great grandchildren, and several nieces & nephews. One charged after shooting on 59 Highway

A St. Joseph man is accused of shooting at a vehicle on 59 highway and then holding a resident at gunpoint for keys to a truck which eventually got stuck in a muddy field.

Zachary Bixby, 23 is charged in Buchanan County with a felony of unlawful use of a weapon.

According to court documents, around 10:30 a.m. on Saturday Bixby and another man were spotted near the Dollar General Store on King Hill Avenue in a stolen Volkswagen Beetle.  Capt. Shawn Collie with the Buchanan County Sheriff’s Office said two people tried to confront the men, one of which knew the vehicle had been stolen earlier in the morning from a friend.  Bixby and the other man allegedly fled the area in the stolen vehicle and the witnesses followed.

They continued into the area of the 9000 block of S. 59 Highway where the stolen vehicle allegedly slowed down and pulled over onto the shoulder of the northbound lane.

“According to victim and witness statements, Bixby and Butts exited the Volkswagen Beetle and Bixby began firing a handgun at the vehicle,” Collie said.

One round hit the hood of the other vehicle.  The men allegedly split-up and went in separate directions.  Collie said Bixby ran into a home in the 8900 block of 59 HWY.

“Once inside, Bixby came into contact with the homeowner who advised Bixby pointed a handgun at him saying he wanted the keys to his vehicle,” Collie said. “He told Bixby the keys were in the vehicle and Bixby left the residence and entered (the victim’s) Ford F-150.”

Court documents said Bixby drove the stolen pickup a short distance into a field where he got stuck.  After running from the truck on foot he was taken into custody.

“A search of the route that Bixby used to flee from the pickup was conducted and investigators located a loaded SCCY 9 mm handgun,” Collie said.

The second man was taken into custody on 59 HWY just north of where the shooting took place.

Bixby is also wanted on a felony warrant out of Clay County for first-degree robbery. He is due in court Tuesday morning for an arraignment. Bixby is currently being held without bail in the Buchanan County Jail.
