Braymer Man Sentenced for $262,000 Cattle Fraud

USDOJ coinA Braymer, Mo., man was sentenced in federal court Monday for a cattle fraud scheme that resulted in losses of more than $262,000 to his victims.

Tammy Dickinson, United States Attorney for the Western District of Missouri, announced that Garland Joseph “Joey” Nelson, 22, of Braymer, was sentenced by U.S. District Judge Howard F. Sachs to two years in federal prison without parole.

The court also ordered Nelson to pay $262,450 in restitution to his victims, including the USDA Farm Service Agency, Cyclone Cattle Company and individual victims.

The government may enforce restitution and the recovery of government property under lien at any time. Nelson must report to the Bureau of Prisons on Nov. 21, 2016, to begin serving his sentence.

On Nov. 30, 2015, Nelson pleaded guilty to a fraud scheme using property mortgaged or pledged to farm credit agencies. Nelson engaged in a three-part fraud scheme that caused a combined loss of $262,450.

Nelson admitted that he engaged in a scheme to sell at least 114 mortgaged head of cattle that were pledged to the Farm Service Agency (FSA), without notifying FSA of the sales, from April 1, 2013, through June 2014. He did not instruct purchasers to address proceeds checks to the FSA as well as to him, and he did not remit the bulk of the sale proceeds to FSA, as was required by the terms of his loans. Instead, Nelson admitted that he kept the funds for his personal use.

Nelson received two livestock operating loans in April 2013 totaling $158,000 for the limited purpose of buying and raising cattle. In violation of the express terms of his loans, and with fraudulent intent, Nelson conducted livestock sales from April 2013 to July 2014 under the name “Joey Nelson” to avoid detection. He conducted other sales in the name of a friend to further conceal his involvement. His friend then transferred the proceeds to Nelson.

Nelson ceased making repayments on his FSA loans as of Jan. 12, 2015. His outstanding principal balance is $138,452, plus applicable interest and penalties. Nelson filed for Chapter 7 bankruptcy on June 25, 2015.

Nelson also schemed to remove identification from cattle that was owned by others but placed in his care to graze. Nelson removed identification tags from 646 head of cattle that belonged to others, and commingled these cattle with his own and with those owned by his neighbor and landlord, in order to sell livestock undetected. He sold those cattle for his own benefit, for a total loss to three victims of $124,000.

Trucker killed in single vehicle crash in Carroll County

MSHP badge goldA truck driver from Leeton, Missouri was killed Monday morning in a single-vehicle crash in Carroll County.

A crash report says a Freightliner driven by Randy Rader, 44, left Missouri Highway 10 at 10:20am. The truck hit a guardrail and a concrete culvert and then partially overturned.

Rader was pronounced dead at the scene of the crash.

Bicyclist killed in SE Kansas crash

KHP-Patch2.jpgA bicyclist from Australia was killed when he was hit along a southeastern Kansas highway.

The Kansas Highway Patrol crash report says Michael John Balfe of Claremont, West Australia was riding on U.S. Highway 54 east of Eureka, Kansas at 8am Monday. His bicycle was hit from behind by a car and shoved into a ditch.

The motorist, identified in the crash report as 32-year-old Shawn Patrick Echols of El Dorado, Kansas, was not injured.

Woman seriously hurt in Clinton County crash

Train With MSHPA Kansas City woman suffered serious injuries in a single-vehicle crash in Clinton County Monday afternoon.

The Missouri State Highway Patrol says Lisa Dowell lost control of her vehicle along I-35 northeast of Lathrop just before 3pm Monday.

The car hit the guardrail and went down an embankment.

Dowell, 50, was transported to North Kansas City Hospital.

Missouri Western reports enrollment including record graduate student numbers

MWSU banner transforming livesSt. Joseph, Mo. – Missouri Western State University recently reported enrollment numbers which included a record number of graduate students.

According to a news release from Missouri Western, enrollment was reported on Sept. 28, at 5,388 including a record 243 graduate students.

“We are pleased that our relatively young master’s degree programs continue to see steady, sustainable growth,” said Dr. Jeanne Daffron, provost and vice president for academic affairs. “This remains an opportunity for continued growth in the future, especially as we continue to bring new programs online, including our MBA program starting next year.”

The total enrollment is about 3 percent below last year’s total. One reason may be the improving economy, said Dr. Paul Orscheln, associate vice president for enrollment management and student retention.

“We saw a significant drop in the number of students age 30 and over, and that was a major factor in our overall numbers,” Dr. Orscheln said. “That’s usually an indication that adult learners are entering the work force rather than going back to school.”

Despite the decline, Dr. Orscheln said there are positive trends in the official enrollment numbers including the retention rate or percentage of last year’s first-time full-time freshman class that returned for their sophomore year. That percentage is the highest in the last nine years and the second highest on record. Also the number of new students, including first-time full-time freshmen and new transfers is up 3.4 percent over a year ago.

US Supreme Court leaves Kansas capital serial-murder conviction in place

US SUPREME COURT LOGOThe U.S. Supreme Court on Monday declined to review the case of John Robinson leaving his capital murder conviction and death sentence intact.

Kansas Attorney General Derek Schmidt says the high court’s denial means Robinson’s conviction and death sentence, which previously were affirmed by the Kansas Supreme Court, will stand on direct appeal.

The case will next be returned to the Kansas courts for further proceedings under the Kansas death penalty statute. Although the U.S. Supreme Court’s action marks the end of Robinson’s direct appeals, under both Kansas and federal law Robinson has remaining options to seek further judicial review through collateral proceedings.

Robinson was convicted in 2002 in Johnson County District Court of capital murder in connection with the serial murders of at least six women.

This is the first death penalty case to exhaust direct appeals since the Kansas Legislature reinstated the death penalty in 1994. Robinson is one of 10 people under sentence of death in Kansas. The other death penalty cases that remain pending at various stages of direct appeals before the Kansas Supreme Court are: State v. Scott Cheever (Greenwood County); State v. Gary Kleypas (Crawford County); State v. Jonathan Carr (Sedgwick County); State v. Reginald Carr (Sedgwick County); State v. Sydney Gleason (Barton County); State v. Justin Thurber (Cowley County); State v. Craig Kahler (Osage County); State v. Frazier Glenn Miller (Johnson County); and State v. Kyle Flack (Franklin County).

In an eleventh case, State v. Doug Belt (Sedgwick County), the defendant died in prison, but the appeal remains pending and the Kansas Supreme Court held oral argument on September 16.

unnamedGeradette “Geri” Murray Dyche, 64, of Hoyt, formerly of Topeka, died Friday, September 30, 2016 at the University of Kansas Medical Center in Kansas City.
She was born November 14, 1951 in Visalia, CA, the daughter of John and Ezaura Sylvia Vierra. She graduated from Tulare Union High School in Tulare, CA in 1969 and attended Harvey Mudd College in Claremont, CA.
Geri was a former member of Most Pure Heart of Mary Catholic Church in Topeka, and a Lector at the church. While living in St. Joseph, MO she attended Our Lady of Guadalupe Catholic Church. In Topeka she was involved in Cub Scouts and Boy Scouts, the Catholic Singles Group, Beginning Experience and the Topeka Chamber of Commerce.
She moved to Topeka after being hired by Adams Business Forms to automate all company processes. She later built and managed her own business for many years, eBiz Software.
On October 11, 2003 she married Steve Dyche in Clinton, MO. They made their home in St. Joseph, MO, until recently moving to the Hoyt area. He survives, of the home.
Geri was preceded in death by her parents and her grandmother, Agnes Sylvia.
Other survivors include a son, Bryan Murray and fiancé Casey Cole, Fort Collins, CO; a step-son, Steven Dyche and wife Cathie, St. Clair, MO; a step-daughter, Lynn Bowser and husband, Peter, New Haven, CT; one brother, Gene Vierra and wife Marcia, Arroyo Grande, CA, a sister, Cynthia Shaffer and husband Reed, Tulare, CA; ten grandchildren and one great grandson.
Mass of Christian Burial will be 10:30 a.m. Tuesday, October 4th at St. Francis Xavier Catholic Church in Mayetta. Burial will follow in St. Joseph Cemetery at Hoyt. Geri will lie in state Monday at the Chapel Oaks Funeral Home in Hoyt where visitation will be from 6:00 to 8:00 p.m. with a Rosary prayed at 6:30. Vicki was preceded in death by her parents, two brothers, Clyde Brandon JR, and Dewayne Brandon, three sisters, Darla Christensen, Betty Bradbury, and Marcy DePew. Tamela “Tammy” Kalamon, 66, of St. Joseph, Missouri passed away Saturday, October 1, 2016 at her home. She was born June 19, 1950 in St. Joseph, MO. She graduated from Lafayette High School, and married Steven Kalamon on March 10, 1970. She was a homemaker who enjoyed cooking fish, and spending time with her family. She was a Catholic. She was preceded in death by father, Donald Townsend, mother, Jeannine Jo Bates, two sons, Steven Kalamon and Jeffrey Kalamon, and a brother, Michael Lane. Survivors include, husband, Steven Kalamon of the home, son, Chad (Shelly) Kalamon of Agency, MO, grandchildren: Ashley, Steven, Mariah, and Tessa, and a great grandchild Kayden Evans, three brothers, Terry (Renatta) Lane of Tacoma, WA, Larry (Valerie) Lane of Talala, OK, and Donnie Lane of Joplin, MO, and a 1/2 brother, David Lane.

She was born November 9, 1939, in Nodaway, Missouri.
Mary graduated from Lafayette, Class of 1957 and worked at Heartland Hospital for many years before retiring.
She enjoyed crafts, flowers, hummingbirds, her cats and giving to the Humane Society. The most precious thing to her was her family, especially her grandchildren.
She was preceded in death by her husband, Roy “Red” Campbell; parents, Carl and Anna (Meadows) Arn; and brother, C. Duane Arn.
Survivors include sons, Darin Campbell (Kristen) of Kearney, Missouri and Brian Campbell of Parkville, Missouri; brothers, Donald Arn (Nancy) and Kenneth Arn (Pam); sister-in-law, Diana Arn; grandchildren, Gaige, Avery, Spencer, Bryce, and Kaleb; and numerous nieces and nephews.

Jury trial gets underway for man accused in death of wife

Martin DavisTrial got underway Monday with jury selection for a man charged with first-degree domestic assault. If convicted of the class A felony, Martin Davis could be sentenced to from 10 to 30 years or life in prison and must serve 85% of that sentence.

Davis is accused of the beating of his wife Sandra Dee Davis back in May of last year at the couple’s home. The victim was seriously injured and died from her injuries.

Jury selection got underway on Monday in the courtroom of Judge Daniel Kellogg. The trial is expected to last all week.

Missouri Western Speech and Debate team presents “Trump vs. Clinton”

Missouri Western LogoSt. Joseph, Mo. – The Missouri Western State University Speech and Debate team will present a “Trump vs. Clinton” debate this week.

Members of the program will represent the two major-party candidates in an objective, Lincoln-Douglas style debate on the issues facing the next president.

After the debate, attendees will have the opportunity to register to vote.

The debate begins at 1 p.m. on Thursday in the Kemper Recital Hall, Spratt Hall room 101.

The event is free and open to the public.
