Nixon off the hook; governor won’t have to represent indigent assault suspect in court

A judge has sided with Governor Jay Nixon in a budget dispute with the director of the state’s Public Defender’s Office.

Director Michael Barrett went so far as to assign the governor to defend an assault case in Cole County. Barret had argued he has the statutory authority to “appoint any member in good standing with the Missouri Bar.” A Cole County Judge disagreed.

Gov. Nixon’s issued the following statement regarding the order issued Thursday in Cole County affirming that the Public Defender has no authority to appoint private counsel:

“Three years ago, we passed common-sense legislation to assist the Public Defender in managing caseloads and established a specific legal process by which the circuit court, and only the circuit court, can appoint private attorneys to provide representation to indigent criminal defendants. This bipartisan legislation had broad support, including from the Public Defender Commission and the then-executive director of the Office of Public Defender. The current executive director has ignored this law, instead engaging in publicity stunts that waste taxpayer resources and distract from their important work.

“I have always supported indigent criminal defendants having proper legal representation. During my tenure, the Office of Public Defender has seen a 15 percent increase in funding and a nearly five percent increase in staff, even while other state agencies have had to tighten their belts and full-time state employment has been reduced by nearly 5,100. As with any agency – especially an agency that has had an increase in funding and personnel – the Office of Public Defender should strive to improve the efficiency of its operations before asking the taxpayers for more money, including taking action to recover the more than $70 million in uncollected legal fees identified in the most recent state audit of the agency by the Missouri State Auditor.”

“From the outset, it was clear that the executive director of the Office of Public Defender did not have the legal authority to appoint private counsel. It is my hope that following today’s order denying this patently unlawful action, the Office of Public Defender will now return its attention to the job it has to do, and the resources already available with which to do it.”

The 2016 Sound of Speed Airshow also includes the sound of music this weekend at Rosecrans Memorial Airport.

Lt. Col. Byron Newell with the Air National Guard 139th Airlift Wing said this year’s event features not only the airshow but a military open house and a concert.

“It’s just a fantastic day of family entertainment,” Newell said. “You’re going to see amazing demonstrations of aerobatics in the air, the different aircraft both military and civilian.”

Rosecrans Memorial Airport Manager Abe Forney said, this year, Season Seven American Idol winner David Cook will be performing Saturday night.

“You don’t just get cars and airplanes out at the airshow, we wanted it to appeal to everybody, so we thought we’d add a concert piece to it,” Forney said. “We got the idea (that) maybe we could have somebody that’s somewhat local. David Cook is from Blue Springs area, we said maybe we could get him. He’s done a USO tour with the military so we thought he might want to come out and do the airshow and, lo and behold, he did.”

Also performing as the opening act will be country artist Danika Portz from Remsen, Iowa.

There will be many things to see during the airshow including an F-16 demonstration, the Shock Wave Jet Truck and the U.S. Navy Seal Parachute Team, “The Leap Frogs.” There will also be an open house with a variety of ground equipment to explore. Newell said the C-130 which was trapped in the hangar during the 1993 flood will be on display.

“We called it the “Flood Bird,’ but you can see the mark on the inside where they marked where the water got up to,” Newell said. “Through the efforts of the maintenance folks here in St. Joe and support of the community that airplane was restored to full flying status.”

There will also be food vendors at the airshow. All proceeds from the show benefit the local United Way Charities.

Gates open for the Sound of Speed Airshow at 11 a.m. on Saturday and 8 a.m. on Sunday at the Rosecrans Memorial Airport. The concerts begins at 5:30 p.m. on Saturday.

(Update) Three hurt in I-29 crash

I-29 Frederick 160825
A three-vehicle crash on I-29 near Frederick slowed traffic on the interstate Thursday morning.

The accident was reported shortly before 8am. The initial reports placed the accident south of the interchange, but emergency crews had to turn around when they located the crash north of Frederick.

In a crash report, the Missouri State Highway Patrol said the chain reaction crash began when one vehicle hit another one stopped on the outside shoulder.

The crash report says three people were hurt. They were identified as Jeanna Curtis, 32, and Jennifer Hood, 37, both of Forrest City, and Veronica Thomas, 60, of Savannah. The patrol says all three were transported to Mosaic Life Care, although ambulance radio traffic from the scene indicated that one of them refused medical treatment.

Two hurt in Nodaway County crash

A single-vehicle crash in Nodaway County Wednesday afternoon sent two people to the hospital.

The Missouri State Highway Patrol says Clifford Hiles, 51, of Skidmore, was driving a box truck along U.S. Highway 71 in Wilcox when the vehicle left the roadway and overturned.

According to the crash report, Hiles suffered minor injuries. His passenger, 42-year-old Jeremy Lamm suffered what were described as moderate injuries. Both were transported to SSM Health St Francis for treatment.

Storm reports from throughout the region

wpid117216-wpid-nwslogo.gifSt. Joseph may have dodged the severe weather on Wednesday evening, but a lot of folks elsewhere in the region were not so lucky.

There were also several reports that turned out to be false.

*In Moberly, Missouri the top of a storage building was blown onto the street.
*Hail the size of tennis balls was reported by weather spotters along I-70 in Leavenworth County, Kansas.
*South of Olathe, Kansas, law enforcement and media reports indicate that upwards of 15 power poles were blown down along highway 169 between 159th and 175th Street, closing the highway briefly.
*National Weather Service employees reported a funnel cloud visible from their Pleasant Hill offices. No damage reports were noted.

A storm Tuesday night caused widespread damage in the Omaha area. Several thousand utility customers in eastern Nebraska could remain without power until Thursday afternoon because of the damage caused by thunderstorms. Omaha Public Power District officials said Wednesday that crews had restored power to more than two-thirds of the 9,700 customers who lacked power Wednesday morning. But just over 3,000 OPPD customers still lacked power Wednesday afternoon. The Tuesday night storm generated 70 mph wind and heavy rain in Omaha that knocked down trees and power lines.

There were also several reports that are being disputed by the National Weather Service. Officials say an automated report from the Lawrence ASOS system noted wind speeds greater than 90 miles-per-hour. The weather service says this was an erroneous report and was not accurate.
