Court appearances scheduled in Powell death investigation

Several defendants charged in connection with the fatal shooting of 18-year-old Skylar Powell are out on bond ahead of court appearances slated in the case.

As we previously reported, five people were charged after Powell was found dead in the 2200 block of Calhoun last month in St. Joseph.

According to online court documents, Monday preliminary hearings scheduled for Ashten Surritte, 19 and Kyle Smith 25 were continued to July 6 at 11 a.m. Kyle Smith is charged with a felony of possession of a controlled substance and a felony for tampering with physical evidence. Surritte is charged with a felony for first-degree attempted robbery.

A 16-year-old charged in juvenile court with felony murder in the second-degree is slated for a hearing (correction) July 13. Because it’s a juvenile case very few details are being released at this time.

Two other defendants, Justin Smith, 20 and Dayne Matthews, 19 are slated to appear in court Monday, June 27 for a preliminary hearing at 3 p.m.

Justin Smith is charged with felonies for voluntary manslaughter and armed criminal action, Matthews is charged with felonies for possession of a controlled substance and tampering with physical evidence.

According to court documents Kyle Smith, Justin Smith and Matthews are currently out on bond. Bond conditions listed include no contact with others charged in this incident. Court documents show Surritte remains behind bars on $20,000 bond.

Heat-related ambulance calls on the rise as summer begins

Buchanan County EMSIt’s tough to get a firm count of the number of times local paramedics will respond to heat-related emergencies. Many people suffering from the heat get classified by the underlying health issue, like chest pains or difficulty breathing.

“With most calls that we get, they’re going to be funneled into other categories,” says Paramedic Jace Drake of Buchanan County E.M.S.

“They exacerbate other underlying medical issues, so they could call in for a heat-related complaint, but it could end up being a “shortness of breath” or “chest pain” or something like that, and so we keep track of those.”

At least one call regarding a possible “heat stroke” was dispatched Tuesday, and as summer gets underway, Drake expects to see an increase in the number of heat-related calls, regardless of how they wind up being classified.

“Within the last week or so there’s been about three or four heat-related calls, and by the end of summer we’ll see 30 or 35.”

unnamed (30)HOLTON – David W. Streit, 38, of Holton, was found Saturday, June 18, 2016 at his home.
He was born August 15, 1977 at Sabetha, the son of Herbert and Denise Winters Streit. He attended Holton Schools and received his High School diploma about a year ago from Fresh Start, an accomplishment he was very proud of.
David worked at a variety of jobs. He did car detailing, and cut and sold wood. He also worked at Hutton Monuments in Topeka and for Strube Monument Service in Holton, and helped work on cars at Complete Car Care in Holton.
He was preceded in death by his grandparents, Arnold and Lola Streit, and John and Marie Winters, and by an aunt, Karla Grau.
Survivors include his parents, Herbert and Denise Streit, Holton; two sisters, Kerry Becker and husband Justin, Holton, and Amanda Wright, Topeka, two nieces, Kelsi and Lauren Wright, one nephew, Micah Becker, and numerous aunts, uncles and cousins.
Cremation is planned. Memorial services will be 10:30 a.m. Saturday, June 25th at the Chapel Oaks Funeral Home in Holton. Memorials are suggested to the David Streit Memorial Fund, to be used to help with expenses, or the Heart of Jackson Humane Society, and may be sent in care of Chapel Oaks Funeral Home, P. O. Box 1034, Holton, KS 66436.

Mass of Christian burial will be Thursday, June 23, 2016 at 10:30 A.M. at St. Benedict’s Church with Abbot Barnabas Senecal, OSB as celebrant. Interment will follow in Mt. Calvary Cemetery. A rosary will be recited on Thursday at 9:30 A.M. at St. Benedict’s Church with visitation to follow until 10:30. Memorial contributions are suggested to St. Benedict School Endowment and may be left in care of Arensberg-Pruett Funeral Home with whom the final arrangements have been entrusted.
Lucy was born on August 6, 1918 in Atchison County Kansas the seventh child of George Anton and Lucy Bridget (Colgan) Diebolt. She graduated from Mount St. Scholastica Academy in Atchison and continued to take classes through the Civil Service as well as various colleges throughout her life.
She traveled extensively in Cuba, Japan, China, Ireland and Portugal and lived for a short time in Alaska.
She earned the Meritorious Civilian Service Award, one of the highest civilian awards that can be granted by the Air Training Command. She retired after thirty five years as a federal employee, thirty years of that time at Mather Air Force Base in Sacramento, California. She first came to work there as a statistical clerk and was serving as a program analyst in the comptroller division at the time she retired. She returned to Kansas in February of 2013.
She was preceded in death by her parents, her brothers, John, Ralph, George and Joe and two sisters, Catherine Bryant and Dorothy Ebbrecht Merrigan.
Lucy is survived by many nieces and nephews and even more grand nieces and nephews, and a sister-in-law, Mrs. George (Mary Lou) Diebolt of Atchison, Kansas.
Even though she remained single all her life, she cared for her immediate and extended family with a generosity that knew no boundaries.

She was born February 9, 1932 in Springfield, Missouri.
Dixie married Lloyd L. White, Sr. in 1949. She worked for Noma Lights for several years prior to being a housewife.
She enjoyed cooking and gardening. Dixie loved the holidays and her family was most important to her.
Mrs. White was preceded in death by her husband, Lloyd Sr.; parents, Donald and Flora (Grable) Morlock; son, Lloyd White, Jr.; and sisters, Charlotte Kerns and Nina Pratt.
Survivors include son, Gaylen White (Phil), St. Joseph, Missouri; three grandchildren, Michael White, Los Angeles, California, Christopher White (Amber), Cameron, Missouri and Gail Brown (Eric), St. Joseph, Missouri; three great-grandchildren, Christina, Gabe and Presley White; sisters, Elaine Kretzer, Houston, Texas, Betty Pilcher, St. Joseph, Missouri and Claudia Butler, St. Joseph, Missouri; and numerous nieces and nephews.

Kansas settlement with Apple over e-book price fixing yields $3.8M to consumers

kansas attorney general logoKansas consumers who purchased electronic books (e-books) are expected to receive approximately $3.8 million from a legal settlement from a price-fixing case against Apple, Inc.

Kansas Attorney General Derek Schmidt announced the settlement details Monday.

Schmidt says Kansas is part of a group of 33 states to investigate and sue Apple for its participation in a conspiracy with publishers to artificially inflate e-book prices to the detriment of consumers. The states prevailed in federal district court in New York and in the United States Court of Appeals for the Second Circuit. When the U.S. Supreme Court in March declined to hear Apple’s further appeal, the current settlement became final.

In 2012 and 2013, Kansas and the other states reached settlements with five major e-book publishers – Hachette Book Group Inc., HarperCollins Publishers LLC, Simon & Schuster Inc., Holtzbrinck Publishers, LLC, d/b/a Macmillan, and Penguin Group (USA) Inc. Kansas consumers received approximately $1.4 million in March of 2014 as a result of those settlements. The settlement with Apple resolves the remaining price fixing claims brought against the group of companies by Schmidt and the other attorneys general.

“The distribution of these refunds brings to a close the long legal battle over e-book price fixing,” Schmidt said. “These competitors together conspired to push the price of e-books higher than the market rate. While each consumer may have seen only a small price increase, altogether these companies collected millions of dollars by artificially inflating the price.”

Distribution of the consumer payments was expected to begin on June 21. The amount any individual consumer will receive depends on how many qualifying books the consumer bought. Customers who purchased e-books through Sony or Google will receive checks in the mail. Customers who purchased e-books through Amazon, Apple, Barnes & Noble, or Kobo will automatically receive credits in their accounts (unless they previously requested to receive checks). Customers receiving account credits should expect to receive an email between June 21 and June 24, indicating that the credits are available in their accounts. Because of the large number of consumers affected, it will take a few days to fully load account credits, and some consumers may not see credits in their accounts until June 24. Credits can be used to purchase anything sold by these retailers, not only e-books.

Crews put out Midtown porch fire

Fire crews made quick work of a structure fire in the 2600 block of Sacramento Tuesday. Crews from the St Joseph Fire Department were dispatched shortly after 6am Tuesday.

The first engine company to arrive spotted a small fire on the back porch. Crews put the fire out in about half an hour.

There’s no word yet on what caused the fire. A fire inspector was dispatched to the scene. There were no injuries reported.

Smithville woman injured in St Joe crash

A crash at I-29 and Frederick shortly before 5pm Monday injured a Smithville, Missouri woman.

The Missouri State Highway Patrol crash report says 21-year-old Kristen Clements was following too closely behind another vehicle on the northbound exit ramp and struck the second vehicle in the rear bumper.

Ms Clements suffered moderate injuries and was transported to Mosaic Life Care for treatment. The other driver was not hurt.
