Senate approves new use-of-force rules for Missouri police

Missouri StatehouseJEFFERSON CITY, Mo. (AP) — The Missouri Senate has endorsed updating the state’s laws on when police can use deadly force.

Senators gave initial approval Wednesday to legislation that would bring Missouri’s use-of-force statute into compliance with parameters outlined in a 1985 U.S. Supreme Court decision.

The court has ruled police can only use deadly force when an officer believes a fleeing felon poses a serious threat to others’ safety. Missouri’s law does not specify that a fleeing felon has to be dangerous.

The legislation also would allow anyone who believes their constitutional rights have been violated to bring a lawsuit in state court. Bill sponsor Senator Bob Dixon faced resistance from fellow Republicans who said that could encourage frivolous lawsuits.

The bill needs another vote before going to the House.

Collapse risk hampers probe of Princeton Square fire

MDPS logo smallAn investigation continues at the site of a fire that destroyed part of the town square in Princeton, Missouri  earlier this week.  In a news release, Mike O’Connell of the Missouri Department of Public Safety said there is still a significant hazard of collapse, which is complicating matters for the fire investigators.

“The investigation is continuing at this time. The area of origin was determined to be in Jeff’s Place bar. There is still a significant collapse hazard at the building making it unsafe for investigators to work in at this time. For the safety of the public, the street and entire block have been roped off as well as the side of the Mercer County Courthouse across the street.”

O’Connell says that when the rest of the structure is knocked down, and safety is improved, the investigator will return to the scene to observe any evidence of the fire cause.

The blaze destroyed at least two buildings caused extensive damage to a third.   The buildings housing Jeff’s Place bar, the Mercer County Senior Center and A Better Image Salon Spa & Fitness were destroyed.

Smoke from the fire forced election officials to move one the city’s polling places to the courthouse for Tuesday’s election. There was a water main break on the Princeton Square, but water service was left on to fight the fire.  (Click here for more)

 

 

Family displaced after destructive Midtown house fire

sjfd night featureFire caused extensive damage and displaced a family of four in Midtown St. Joseph early Thursday morning. Crews responded to the home in the 1600 block of South 17th Street, where they found the family safely evacuated.

The cause of the fire is under investigation. There were no injuries, but the house was destroyed.

Crews had trouble with at least one fire hydrant, and some neighbors in the area reported losing electrical power after the fire was put out.

Ag Director to join celebration at St Joe Port Authority

The Missouri Director of Agriculture, Richard Fordyce will be in St Joseph Thursday for a ribbon-cutting ceremony at the St. Joseph Regional Port Authority Facility.

Officials will gather this afternoon at the facility off Fourth Street near the Missouri River railroad bridge to celebrate the addition of new equipment needed to unload bulk product from barges onto trucks.

The St. Joseph Regional Port Authority was formed in 1987 and has had a long road of redevelopment efforts in the Stockyards Industrial Park to become a functioning river port and multi-modal facility.

The facility currently serves primarily to bring fertilizer into the region and to ship out grain products.

The event at 2 p.m. will be hosted by the St. Joseph Chamber of Commerce.

 

 

Doniphan County paving scam investigated by Kansas Attorney General

The Doniphan County Sheriff’s Office is alerting residents of repaving scam, and offering some advice about what to do if you were conned.

In a social media post, officials said the Kansas Attorney General’s office is investigating numerous complaints from residents of Doniphan County in reference to the Missouri company Chip And Seal. The company was in the area repaving driveways then charging a different amount of money than originally agreed upon.

From the Facebook post: “If you feel like you have been a victim of fraud by the paving company, Chip and Seal from Hannibal, Missouri, please obtain all receipts received from the company and the type of payment. If you paid by check please obtain a copy of the front and back of the check.

“Once all documents are received you may either go online to www.ag.ks.gov to file a complaint or bring all documents to Doniphan County Sheriff Department and all documents will be sent to the Attorney General’s office.”

Chillicothe man seriously injured after crash with deer

wpid-mshp-logo111.jpgA Chillicothe man was taken to the hospital Tuesday night after the vehicle he was driving hit a deer in Livingston County.

According to the Missouri State Highway Patrol, Dennis Evans, 52 was driving a 1995 Honda Shadow southbound on country road 419 about 2.5 miles south of Utica a little after 7 p.m. when he hit a deer in the roadway.

Evans was taken by ambulance to hedrick Medical Center with a serious injury.  He was reported to be wearing a seat belt.

St. Joseph man accused of trying to meet child for sex in Andrew County

A St. Joseph man is accused of trying to meet a 9-year-old at a park in Amazonia Monday to engage in sexual relations.

Alexander Wyble, 17 (age corrected, born in 1998) of St. Joseph is charged in Andrew County with a felony for attempted statutory rape.

According to court documents, in February Detective Alan Whaley began chatting using the Text Now application with and individual on a phone which had been turned over authorities due to suspicious messages received.

“I was later able to identify the subject as Alex Wyble,” said Det. Whaley. “The chats with Mr. Wyble consisted of discussing our ages such as the chat on 03-04-16 ‘Ok so you want to date him? How old are you? (I replied “9”) He is 17 and your mom can’t find out if you date him here he is if you want to text him. Mine is Alex but my little brother his is the same. Yes I like younger girls.'”

Det. Whaley said during another string of texts Wyble also engaged in instructing the minor child how to engage in sex acts and sent the child pornographic photos on four occasions.

“Mr. Wyble told the minor child to let him know when she was in St. Joseph and he would meet her,” Det. Whaley said. “On 04-04-16 Mr. Wyble instructed the minor child to meet him in Amazonia at the park and they could play.  Mr. Wyble stated he would drive his ATV to the park.”

An agent observed Wyble drive a red ATV to a gravel lot across the the Amazonia city park located on K Highway.

“Wyble was observed watching the park from a small building located across the street from the park.  Mr. Wyble sent the minor child a text, ‘I am Right across the street,'” Det. Whaley said.

Wyble was taken into custody Monday at that location.

“During the interview, Mr. Wyble confirmed he was chatting on Text Now as Alex, he made arrangements to meet a nine year old female in the city park and intended on engaging in sexual intercourse,” Det. Whaley said. “He also confirmed he sent adult pornography pictures to the nine year old.”

Wyble is being held without bail in the Andrew County Jail.  A court date had not yet been sent as of Wednesday morning according to online court documents.

Voters decide tax issues across the region

Voters in a number of jurisdictions decided tax issues in Tuesday’s election.

Most of the tax questions were approved, although voters in Mound City decided to discontinue one part of the city’s local sales tax.

Mound City voters agreed to discontinue applying and collecting the local sales tax for the titling of motor vehicles, trailers, boats and outboard motors bought from someone other than a licensed Missouri dealer. They also agreed to implement a local use tax for out of state purchases. The use tax will match the local sales tax, currently 1.5%, regardless of whether the sales tax is increased, decreased or discontinued in the future.

Andrew County voters passed two tax issues relating to road repairs. A property tax levy renewal was okayed by a white margin 88% to 12%. The renewal of the sales tax in Andrew County also passed, by a similar margin, 89% to 11%. The renewals come with a sunset clause and do not increase either tax.

Harrison County voters agreed to renew that county’s sales tax by a 43% to 17% margin.

Kansas City voters overwhelmingly renewed the city’s 1% earnings tax for another five years. The measure passed with 77 percent of voters citywide saying yes, according to unofficial final results. Voters in St Louis also strongly supported that city’s earnings tax, approving renewal by about 72% to 28%. In Kansas City, wage-earners must pay one percent of their earnings, regardless of where they live. The tax in Kansas City makes up about 40% of the city’s general fund and supports fire and police operations.
Officials hope the election sends a message to state lawmakers hoping to end the earnings taxes in KC and St. Louis.

Evelyn A. Loyd
1922-2016

eveEvelyn A. Loyd, 94, of Hiawatha, died peacefully Monday evening, April 4, 2016, at Maple Heights Nursing Home in Hiawatha, where she had been a resident a few weeks.
Evelyn was born February 26, 1922, at Denton, Kansas, one of five daughters born to Charles and Lucy May Swartz Gish and had lived in the northeast Kansas area her entire life. She grew up at Denton, attended grade school there prior to graduating Denton High School with the class of 1939. Evelyn graduated Highland Community Junior College with an associate’s degree prior to attending Kansas State University for a year.
Mrs. Loyd was a longtime member of the Powhattan United Methodist Church and UMW of the Church. While her children were young, she was a 4-H sewing leader. Also a member of Wenger Post #373, Powhattan American Legion Auxiliary; NeoCentury Study Club; Grand Prairie FCE Unit; and the Grand Prairie Club. She also enjoyed getting together with several ladies and quilting for the Brown County Historical Society. One of her greatest joys was making wedding dresses for her daughter and grand-daughter.
She was married to Carroll H. Loyd, October 30, 1943, at her parent’s home at Denton. They farmed and raised livestock near Powhattan until retiring in 1983. She also drove a school bus for Powhattan Schools for 7 years. They moved to Hiawatha to make their home in 2001. Through the years, they enjoyed taking trips with the family. He died July 8, 2013. She was also preceded in death by her parents; a son Max in 2004; three sisters: Harriet Myers, Elva Mae Booth, and Mildred Eby.
Survivors include three children: Marjorie Loyd, and Duane Loyd, both of Topeka, Carolyn (John) Andres of Hiawatha; a daughter in law Georgia Loyd of rural Hiawatha; a sister Doris Dollar of Tulsa, OK; three grandchildren: Matthew (Allison) Loyd of Tulsa, OK, Lisa (Jeff) Meyer of Ottawa, Bradley (Ashley) Andres of the family farm north of Powhattan; 7 great-grandchildren: Madeline Loyd; Jotham, Josiah, and Elizabeth Meyer; Ava, Cooper and Brentley Andres..
A Celebration of Evelyn’s Life is planned for 10 a.m. Saturday, April 9, at Powhattan United Methodist Church, with Reverend Priscilla Davies officiating. Interment will follow at the Powhattan Cemetery.
Friends may call at Chapel Oaks Funeral Home in Hiawatha after 10 a.m. Friday, where the family will meet with friends from 6 until 8 that evening.

Linda Jo Phillips
1966-2016

She was born July 5, 1966 in St. Joseph, Missouri.
Linda worked at Pappy’s as a waitress and served in the Air National Guard.
She was preceded in death by her aunt, Penny Hayes; and dear friend, Scottie Groce.
Survivors include son, Jeremy Phllips; daughter, Ashley Phillips; mother, Pat Phillips (Cecil), all of St. Joseph, Missouri; father, Richard Phillips (Linda), Pittsburgh, Missouri; sister, Barb McQuiston; grandson, Kamdyn Phillips; fiancé, Rick Terhune; and numerous aunts, uncles, nieces, nephews and cousins.

Helen worked at the Hotel Robidoux for 25 years as an Assistant Auditor and the Boston House and Window Cleaning for 20 years as a Bookkeeper. She was a member of the Church of Jesus Christ of Latter Day Saints.
She was preceded in death by her husband, Norman E. Mix; parents, Robert and Ruby (Wilkinson) Dinning; brother, Robert; and sister-in-law, LaVonne.

1944-2016

Carlton Root 71, of St. Joseph, Missouri, passed away Tuesday, April 5, 2016 in Saint Joseph, MO health care center. He was born October 1, 1944 in Atchison, KS, son of Mary and Horace Root. He graduated from Atchison high school and worked at Blush Mize for 25 years, & Golden Star for 19 years. He was a member of Wesley United Methodist Church. Carlton was preceded in death by wife, Patricia Root, his parents, four brothers, Edward, Orlando, Raymond and Gerald Root. Survivors include, daughter Linda Oliver of Mesa, AZ., step-daughter, Michelle White, step-sons, Richard “Mearl” O’Dell Dallas O’Dell, and several grandchildren.

Edith Mabel McNett
1943-2016

Edith Mabel McNett 72, of Saint Joseph, Missouri passed away Tuesday April 5, 2016 at her home. She was born April 30, 1943 in San Jose, California daughter of Helen & Donald Cunningham. She graduated from Lafayette High School 1961, and worked as a Secretary. She enjoyed fishing, watching all sports and football, crossword puzzles, gardening, and working in her yard. She especially loved her grandchildren and family gatherings. She was a Christian. Edith was preceded in death by her parents, three brothers, Donald, Robert G., and Jerry Cunningham, two sisters, Charlotte Calloway, and Nella M. Veale. She is survived by four daughters, Debra Kay McNett of St. Joseph, MO, Teresa Foster of Stewartsville, MO, Kimberly Ann McNett and Michele Rene McNett, and a son, Butch Edward (Sherry) McNett of Saint Joseph, MO, 9 grandchildren, and several great grandchildren.
