Missouri House proposes tax exemption on utilities for making food

(Missourinet)-The state House has proposed a tax exemption for the use of utilities that go into making food.

The bill aims to exempt the state’s sales and use taxes for restaurants and others who make food to be sold to directly the public for the electricity, water, gas, or other utilities used to make that food.

Representative Judy Morgan (D-Kansas City) said its passage would cost the state.

“It would reduce the total state revenue by $51.2-million, annually,” said Morgan of the bill’s fiscal impact as assessed by state legislative staff. “This is a very bad bill designed for one special interest group. As most bills designed for special interest groups, the taxpayer gets stuck making up the difference.”

Bill sponsor, Representative Craig Redmon (R-Canton) said that estimate is overblown.

“The fiscal note on it took into account things like coolers and freezers, lights and everything else, when in actuality it only takes in electricity on the oven, or the gas used on the fryers,” said Redmon.

He denies the bill is being proposed for a special interest group.

“Yes it will help other people, but when I took this bill on it wasn’t for the big guy, it was for the little guy,” said Redmon.

Representative Lyndall Fraker (R-Marshfield) said taxing both the food and the utilities used to make it is double-taxation.

“Why should the taxpayers, or why should the consumer have to pay tax on a product twice?” asked Fraker.

Critics say a similar exemption has been struck down by the state Supreme Court, but Redmon argues his bill address the Court’s concerns.

The proposal, HB 1448, goes now to the Senate.

(Missourinet) – A state House committee will consider Tuesday a proposal to raise Missouri’s fuel taxes to pay for roads and bridges. That plan has already been approved by the Senate but House Republican leaders don’t favor a tax hike.

House Speaker Todd Richardson (R-Poplar Bluff) says his caucus’ position is the same as it’s been for a while.

“A tax increase of any kind is going to be very difficult to do,” said Richardson.

Still, he says it will go through the committee process.

“We’ve got some members that are interested in giving it a fair hearing and we’ll see where it goes from there,” said Richardson.

The bill would ask voters whether Missouri’s fuel tax should be increased by 5.9-cents. The state’s 17-cent fuel tax is among the lowest in the country.

St. Joseph Senator threatens filibuster on proposed drug monitoring program

(Missourinet) – Unless voters get to make the final decision on a proposed prescription drug monitoring program, Senator Rob Schaaf (R-St. Joseph) will filibuster it. Schaaf says he would support the measure if ballot language and a referendum clause were added so that Missourians can vote on the program.

The House measure passed out of that chamber last month and is being considered by a Senate committee. Sponsor Holly Rehder (R-Sikeston) says Missouri needs the program as soon as possible.

“He (Schaaf) uses those as a stall tactic. He doesn’t want this bill to get through. We have experienced deaths this week. We’ve experienced overdoses this week. We’ve experienced addiction being fed this week,” said Rehder.

The program would let doctors and pharmacists see if a person is having more prescriptions filled than needed. The intent is to prevent those addicted to opioids from overdosing and to stop those who profit from the illegal resale of those drugs.

Schaaf says such programs don’t work.

“There are a lot of people who go to the doctor once a month, get a month’s worth of medication, take it home and sell it for $50 a pill. They make a good living on that. The PDMP will never catch those people from doing that,” said Schaaf. “More people die of alcohol abuse and the effects of smoking of cigarettes than will ever die of opioid overdose.”

Senator Dave Schatz (R-Sullivan) is carrying the Senate version of Rehder’s proposal. He wants to find a compromise.

“Are you just at the point where again this is your way or no way?” asked Schatz. “You say you’re not going to let this come to a vote if it isn’t your way.”

“No, I’d be more than happy to allow the way that is palatable that will protect our liberty,” said Schaaf.

A Senate committee is also considering Schaaf’s plan that he argued would better protect Missourians’ privacy. Under his proposal, the state Bureau of Narcotics and Dangerous Drugs would track prescriptions. Pharmacists and doctors wouldn’t have access to the information. Bureau officials would inform authorities of potential cases of abuse. It is projected to cost the state $6 million compared to $4 million for Rehder’s plan.

Missouri is the only state without a monitoring program for prescription drugs.

(Missourinet) – The state House has rejected a limited legalization of medical marijuana.

The chamber earlier this week gave initial approval to the measure, which would have legalized the use of marijuana only by those in hospice care for terminal cancer. It was a reining in of an earlier, broader version of the bill that would have legalized marijuana use by patients being treated for several specified conditions.

Several lawmakers changed their minds on Thursday’s vote to defeat the proposal, after the vote Tuesday to adopt it.

Missouri House initially approves limited medical marijuana bill

marijuana pills(Missourinet) – The state House has given first-round approval to asking voters whether to approve a very narrow legalization of medical marijuana.

The bill would allow for the growing of marijuana and limit its legal use to those in hospice care for terminal cancer. An earlier version had broader allowances for use by patients with other medical conditions.

Bill sponsor Dave Hinson (R-St. Clair) called the 91-59 vote a step forward.

“Yes, I would have preferred we would have kept it with Alzheimer’s and ALS and other cancer patients that have a need,” said Hinson.

Hinson said during debate he believes medical marijuana might have helped his father, who died of cancer.

“So why don’t we stand up, get the politics out of this room, and do what’s right for dying patients,” asked Hinson.

Some lawmakers stood by their opposition to medical marijuana. Representative Keith Frederick (R-Rolla) said states that have passed such laws have seen increases in illegal use of pot.

“The amount of usage in 12- to 17-year-olds, the high-usage states, it’s all states that have medical marijuana, with the couple of recreational use states way up at the top,” said Frederick.

Some lawmakers who support medical marijuana, including Representative Shamed Dogan (R-Ballwin), voted against the bill, saying it was too “watered down.”

“This bill does not advance the cause of providing compassionate care. It does not advance the cause of getting us toward a more rational place on our marijuana policies,” said Dogan.

Other legislators like Representative Lynn Morris (R-Nixa) said the bill could help some patients nearing the end of their lives.

“I just don’t want to be one … to deprive someone, after the physician, the patient and that family decides that may be the last thing that they could use during their last hours of life,” said Morris.

The debate comes as a petition is being circulated that would put a medical marijuana ballot question before voters. Some lawmakers urged for passage of this bill so that what goes before voters is something that has been vetted by the legislature.

Missouri Senate unanimously supports making sex trafficking advertising illegal

(Missourinet) – Advertising of sex trafficking would be a crime under a proposal that has been unanimously passed in the state Senate. Senator Bob Onder (R-Lake St. Louis) says Missouri is seeing more and more sex trafficking.

“The St. Louis metro area is said to be among the top 20 regions for sex trafficking,” said Onder. “It’s a serious problem.”

The bill would make advertising related to sex trafficking a felony punishable by up to 20 years in prison.

Senator Gina Walsh (D-St. Louis) says that’s appropriate.

“For somebody to take over your life like that, take possession of your passport, threaten your family members. I can’t imagine being a 14-year-old girl and somebody is telling me all these things they are going to do to my family if I don’t cooperate. Of course they’re going to cooperate,” said Walsh.

Walsh says sex trafficking victims are not just young girls.

“A lot of times we forget in some of these crimes against people in domestic violence, human trafficking, young boys and adult men can be victims too,” said Walsh.

The Senate made changes to what was a House proposal so the bill now goes back to the House.

New learning standards adopted for Missouri K-12 schools

bus-878697_1920(Missourinet) – The State Board of Education has approved new learning standards for Missouri’s K-12 students. The changes are for math, English, social studies and science.

Missouri currently follows standards based on federal guidelines known as common core, but the Legislature passed a requirement in 2014 to develop new standards. The changes will begin next school year.

Department of Education Assistant Commissioner Blaine Henningsen calls these minimum standards.

“They don’t differentiate between urban and suburban and rural or anything like that. They don’t differentiate between whether a student has a disability in one area or does not have a disability. They are learning expectations created for all students in Missouri,” said Henningsen.

Ann Jarrett with the Missouri National Education Association is pleased with the changes.

“This ends this period of uncertainty. For two years, teachers have been uncertain about what would the new learning standards would look like. Now we have something we can move forward with,” said Jarrett. “Many of the changes in all of the areas actually deal more with trying to help students understand on a conceptual level rather than just memorizing things,” said Jarrett. “That requires a different way of teaching. It requires some resources for manipulative materials.”

During a public hearing in October about proposed changes by several work groups, opponents said the proposed standards were disjointed and too closely mirrored Common Core guidelines.

The Department of Education received more than 3,600 comments during a public feedback period on proposed standards. The Department says that feedback was considered in the approved changes.

Local districts will determine curriculum to meet the new standards. The Department will work with educators during the transition and will develop new assessments to measure student progress. New assessments for English language arts and math will be administered in spring 2018

Missouri Gov. prefers lesser fuel tax increase proposal to latest, 5.9-cent version

Nixon(Missourinet) – Governor Jay Nixon (D) supports increasing Missouri’s gas tax to help pay for Missouri’s infrastructure, but he’s not a fan of the proposal that passed out of the Senate last week. The bill would ask voters if Missouri’s gas tax should be increased by nearly 6-cents per gallon.

“If I was to order what we should get done, I think the original version of Senator [Doug] Libla’s bill was something that would have made a short term but important step forward. I thought especially with gas prices were they were and are, that would’ve been a doable,” said Nixon.

Libla’s original bill called for an increase of 1.5-cents for unleaded and 3.5-cents per gallon for diesel. He says the Legislature’s failure to find a transportation funding fix led him to propose a greater increase.

Libla’s newer version is headed to the House where leadership is less favorable to increasing taxes to help pay for roads and bridges.

“Let’s get something done while the prices are low and let’s get a couple of cents and let’s start moving forward,” said Nixon. “I’d like to see us do something that we can get done and get done quickly that would have a small but incremental effect.”

Lawmakers are also considering reinstating a cost-sharing program that would create a partnership between state and local governments to split the cost of infrastructure projects.
